BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. Section 17-13-0905 of the Chicago Zoning Ordinance is hereby amended by inserting the language underscored, as follows:

17-13-0905-G Drive-through facility for a restaurant. Any initial or renewal special use approval for a drive-through facility for a restaurant that provides drive-through food service between the hours of Midnight and 7:00 a.m. shall be for a period of five years. With regard to any such facility in existence for less than five years prior to the effective date of this subsection G, the renewal application shall be submitted no later than the fifth anniversary of the date such use was first approved. With regard to such facilities in existence for five years or more prior to the effective date of this subsection G, the Zoning Administrator is authorized to establish a reasonable schedule for their reguired renewal submissions. In addition to other conditions that may be imposed pursuant to Section 17-13-0906, the Zoning Administrator may recommend and the Zoning Board of Appeals may impose reasonable time of operation limits to protect the public health, safety, morals, or general welfare as a condition of approving or reapproving any special use for a drive-through facility for a restaurant. If initial or renewed special use approval application is denied for a drive-through facility for a restaurant that provides drive-through food service between the hours of Midnight and 7:00 a.m., such denial shall not affect the restaurant's lawful drive-through facility operations at other times, provided such restaurant is in compliance with other applicable reguirements.

 

 

 

SECTION 2.  This ordinance shall take effect upon passage and publication.
