SUBSTITUTE ORDINANCE
WHEREAS, the Annual Appropriation Ordinance for the year 2019 of the City of Chicago (the "City") contains estimates of revenues receivable as grants from agencies of the state and federal governments and public and private agencies; and
WHEREAS, in accordance with Section 8 of the Annual Appropriation Ordinance, the heads of various departments and agencies of the City have applied to agencies of the state and federal governments and public and private agencies for grants to the City for various purposes; and
WHEREAS, the City through its Department of Public Health ("Health") has been awarded additional state grant funds in the amount of $9,000 by the Illinois Department of Human Services which shall be used for the Healthy Families Illinois Program; and
WHEREAS, the City through Health has carryover federal grant funds in the amount of $200,000 from the United States Department of Housing and Urban Development which shall be used for the Lead Hazard Reduction Demonstration Program; and
WHEREAS, the City through Health has been awarded federal grant funds in the amount of $1,900,000 by the United States Department of Health and Human Services ("DHHS") which shall be used for the STD Prevention and Control for Health Departments Program; and
WHEREAS, the City through its Mayor's Office for People with Disabilities has carryover public grant funds in the amount of $11,000 from the Chicago Housing Authority ("CHA") which shall be used for the CHA Home Modification Program; and
WHEREAS, the City through its Department of Family and Support Services has been awarded federal grant funds in the amount of $4,588,000 by DHHS which shall be used for the Early Head Start Expansion Program; and
WHEREAS, pursuant to an ordinance adopted by the City Council of the City (the "City Council") on April 19, 2017 and published on pages 46409 through 46461 in the Journal of Proceedings of the City Council (the "Journal") for such date, and as amended by an ordinance adopted by the City Council on November 14, 2018 and published on pages 90538 through 90585 in the Journal for such date, the City's Department of Planning and Development ("DPD") is authorized, among other things, to provide a portion of the financing required for the construction of an affordable housing development (the "Project") to be located at 6320-6352 South Green Street and 832-848 West 64th Street by Montclare Englewood LLC, an Illinois limited liability company (the "Developer"); and
WHEREAS, the City desires to use proceeds ofthe City's General Obligation Bonds, Series 2019A or other lawfully available funds (the "City Funds") in the amount of $100,000 to pay the Developer, or Patti Ann Charitable Services, Inc., an Illinois not-for-profit corporation ("PACS"), or another affiliate of the Developer acceptable to DPD (the "Affiliate"), for required construction work on South Green Street in connection with the Project; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. The sum of $6,497,000 not previously appropriated and representing new grant awards and $211,000 in carryover grant funds are hereby appropriated from Fund 925 - Grant Funds for the year 2019. The Annual Appropriation Ordinance is hereby amended by striking the words and figures and adding the words and figures indicated in the attached Exhibit A which is hereby made a part hereof.
SECTION 2. The Commissioner of DPD and a designee of the Commissioner (each, an "Authorized Officer") are each hereby authorized to enter into, subject to approval of the Corporation Counsel, a contract (the "Contract") with the Developer, PACS or the Affiliate, for an amount not to exceed $100,000 of City Funds, for required construction work (the "Construction Work") on South Green Street in connection with the Project. Each Authorized Officer is hereby authorized, subject to approval by the Corporation Counsel, to enter into and execute such agreements and instruments, and perform any and all acts as shall be necessary or advisable in connection with the implementation of the Construction Work.
SECTION 3. To the extent that any ordinance, resolution, rule, order or provision of the Municipal Code of Chicago, or part thereof, is in conflict with the provisions of this ordinance, the provisions of this ordinance shall control. If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this ordinance.
SECTION 4. This ordinance shall be in full force and effect upon its passage and approval.
