Be It Ordained by the City Council of the City of Chicago:
SECTION 1. Permission and authority are hereby given and granted to POINTE 1900 RETAIL LLC, upon the terms and subject to the conditions of this ordinance to maintain and use, as now constructed, thirteen (13) Planter(s) on the public right-of-way for beautification purposes adjacent to its premises known as 1900 S. State St
Said Planter(s) at S. DEARBORN ST. measure(s):
One (1) at sixty (60) feet in length, and five (5) feet in width for a total of three hundred (300) square feet. Said Planter(s) at W. CULLERTON ST. measure(s):
Four (4) at five point five (5.5) feet in length, and twenty-two point five (22.5) feet in width for a total of four hundred ninety-five (495) square feet.
One (1) at five point five (5.5) feet in length, and ninety (90) feet in width for a total of four hundred ninety-five (495) square feet.
Said Planter(s) at S. STATE ST. measure(s):
One (1) at eight point five (8.5) feet in length, and forty-one point two five (41.25) feet in width for a total of three hundred fifty point six three (350.63) square feet.
One (1) at eight point five (8.5) feet in length, and eighteen point seven five (18.75) feet in width for a total of one hundred fifty-nine point three eight (159.38) square feet.
One (1) at eight point five (8.5) feet in length, and twenty-two point five (22.5) feet in width for a total of one hundred ninety-one point two five (191.25) square feet.
One (1) at eight (8) feet in length, and eighteen point seven five (18.75) feet in width for a total of one hundred fifty (150) square feet.
One (1) at eight (8) feet in length, and twenty-two point five (22.5) feet in width for a total of one hundred eighty (180) square feet.
One (1) at eight (8) feet in length, and thirty-seven point five (37.5) feet in width for a total of three hundred (300) square feet.
One (1) at six (6) feet in length, and forty-one point two five (41.25) feet in width for a total of two hundred forty-seven point five (247.5) square feet.
Grantee must allow the required clear and unobstructed space for pedestrian passage at all times per rules and regulations approved by the Department of Transportation.
The location of said privilege shall be as shown on prints kept on file with the Department of Business Affairs and Consumer Protection and the Office of the City Clerk.
Said privilege shall be constructed in accordance with plans and specifications approved by the Department of Planning and Development and Department of Transportation (Division of Project Development).
This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions of the Municipal Code of Chicago.
The grantee shall pay to the City of Chicago as compensation for the privilege #1124368 herein granted the sum of zero ($.00) per annum in advance.
A 25% penalty will be added for payments received after due date.
The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.

The applicant referenced above has requested the use ofthe public right-of-way for a planter(s). An ordinance has been prepared by the Department of Business Affairs and Consumer Protection - Small Business Center-Public Way Use Unit for presentation to the City Council. Because this request was made for properties located in your ward, as approved by you as per the attached, I respectfully request that you introduce the attached ordinance at the next City Council meeting.
