Your Committee on Transportation and Public Way begs leave to report and recommend that Your Honorable Body pass the proposed ordinance transmitted herewith for a grant of privilege in the public way to RUSH WALTON,  L.P.  - 02011-6835 to maintain and use, as now constructed,  two  (2)   facades on the public right-of-way adjacent to its premises known as 939 North Rush Street.    This ordinance was referred to the Committee on July 28, 2011.
 
This recommendation was concurred unanimously by a viva voce vote of the members of the Committee with no dissenting vote.

Be It Ordained by the City Council of the City of Chicago:
SECTION 1. Permission and authority are hereby given and granted to RUSH WALTON, L.P., upon the terms and subject to the conditions of this ordinance to maintain and use, as now constructed, two (2) Facade(s) on the public right-of-way adjacent to its premises known as 939 N. Rush St
Said Facade(s) at N. Rush measure(s):
One (1) at eighteen point zero seven (18.07) feet in length, and point five eight (.58) feet in width for a total often point four eight (10.48) square feet.
Said Facade(s) at Alley N. of E. Walton measure(s):
One (1) at fifty-four point five three (54.53) feet in length, and point one two (.12) feet in width for a total of six point five four (6.54) square feet.
The location of said privilege shall be as shown on prints kept on file with the Department of Business Affairs and Consumer Protection and the Office of the City Clerk.
Said privilege shall be constructed in accordance with plans and specifications approved by the Department of Planning and Development and Department of Transportation (Division of Project Development).
This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions of the Municipal Code of Chicago.
The grantee shall pay to the City of Chicago as compensation for the privilege #1097485 herein granted the sum of four hundred ($400.00) per annum in advance.
A 25% penalty will be added for payments received after due date.
The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.
