ORDINANCE

WHEREAS, In the first quarter of 2018 the City Council approved a new form of Use and Lease Agreement that will substantially govern airline operations at O'Hare International Airport ("New Use and Lease Agreement"). The execution of the New Use and Lease Agreement by the City of Chicago and the signatory airlines marks an historic moment for the economic growth of our City, and this unprecedented opportunity deserves the City's full attention; and

WHEREAS, It is the goal of the Mayor and the City Council to ensure diversity, inclusion, and maximization of capacity-building opportunities arising from this transformative agreement; and

WHEREAS, In furtherance of the goal, the City should fully leverage all of its locally focused MBE/WBE participation objectives, bid preferences including those for veterans and people with disabilities, and programs to provide opportunities for small, local, and historically disadvantaged businesses; and
WHEREAS, These programs include the Small Business Initiative 1, Small Business Initiative 2, and the Medium Business Initiative, which were created by the Mayor and the City Council and are designed to provide opportunities at the prime contractor level to small through mid-sized local firms of all sizes and backgrounds that are emblematic ofthe rich diversity of our City; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. The foregoing recitals are incorporated into and made a part of this Ordinance.
SECTION 2. (a) The Commissioner of Aviation ("Commissioner") and the Chief Procurement Officer ("CPO") shall convene a working group of City officers and employees who, in the Commissioner's and CPO's judgment, will bring expertise, experience and perspective to effectively address the issues described herein. The working group shall include representatives ofthe City Council, including but not limited to participation by African American, Latino, and women representatives and a representative from each of the Committee on Aviation and the Subcommittee on MBE/WBE. The working group shall also include representatives from each ofthe Departments of Aviation, Procurement Services, and Law, and may also include one or more representatives from the consultants and contractors associated with work pursuant to the New Use and Lease Agreement.
With regard to construction projects and construction-related projects arising from the New Use and Lease Agreement, the working group shall examine how to maximize participation by diverse firms, and encourage growth, capacity-building, and a level playing field for firms of all sizes and backgrounds that reflect the diversity of the City of Chicago. The working group may include in its review the estimated dollar value of upcoming contracting opportunities with the goal of ensuring that project packages have been divided sufficiently to maximize participation of small and mid-sized prime and sub contractors. The working group may also review the processes and procedures for bidding projects.
The working group shall meet periodically and shall provide recommendations to the Commissioner and to the City Council. Such recommendations may include recommendations

for presentations to communities, "town hall" overview meetings, and other outreach plans to ensure that firms are aware of upcoming opportunities.

(d) The working group shall in no way be involved in specification development, bidding, evaluation of or recommendations regarding specific bids, or contract award, nor shall it have access to any non-public information. Any member ofthe working group who does have access to non-public information as part of the performance of his or her day-to-day duties shall not share or discuss any such information with any other member of the working group who does not.


SECTION 3. This ordinance shall be in full force and effect upon passage and approval.
