ORDINANCE

SIMS METAL MANAGEMENT Acct. No. 88710-6 Permit No. 1116379

Be It Ordained by the City Council of the City of Chicago:

SECTION 1. Permission and authority are hereby given and granted to SIMS METAL MANAGEMENT, upon the terms and subject to the conditions of this ordinance to maintain and use, as now constructed, two (2) Switch Track(s) on the public right-of-way adjacent to its premises known as 9300 S. Kreiter Ave

Said Switch Track(s) at E. 93rd St. measure(s):

On and across East 93^rd Court, located one hundred seventy (170) feet east of the line of South Ewing Avenue from a point on the south line of East 93^rd Court running a distance of fifty (50) feet to the west line of East 93^rd Court.

Said Switch Track(s) at S. Kreiter Ave. measure(s):

Beginning at a point two hundred (200) feet south of the south line of East 93^rd Court; thence running along the westerly side of South Kreiter Avenue in a northerly direction, a distance of two hundred forty (240) feet; thence crossing East 93^rd Court at a point of two hundred ninety-three (293) feet east of the east line of South Ewing Avenue; and thence proceeding into private property.

The location of said privilege shall be as shown on prints kept on file with the Department of Business Affairs and Consumer Protection and the Office of the City Clerk.

Said privilege shall be constructed in accordance with plans and specifications approved by the Department of Transportation (Division of Project Development).

This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions ofthe Municipal Code of Chicago.

The grantee shall pay to the City of Chicago as compensation for the privilege #1116379 herein granted the sum of eight hundred ($800.00) per annum in advance.

A 25% penalty will be added for payments received after due date.

The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.
