Be It Ordained by the City Council of the City of Chicago:
SECTION 1. Permission and authority are hereby given and granted to MB REAL ESTATE/AAF ONE NORTH LASALLE PROPERTIES L.L.C, upon the terms and subject to the conditions of this ordinance to maintain and use, as now constructed, one (1) emergency Generator over the public right-of-way adjacent to its premises known as 1 N. La Salle St Existing emergency back-up generator is located on top of a platform adjacent to the second (2nd) story approximately fifteen (15) feet above grade level. Existing platform for which generator is located has four (4) steel support beams/posts. There is six (6) feet of space in between beams/posts to allow pedestrian movement, as well as sufficient access for the disabled, should such be required. Existing area is a little used passage way which cannot accommodate automobiles and is seldom used for pedestrians because it leads only to an alley Existing platform measure twenty-one (21) feet eight (8) inches in length and eight (8) feet eight (8) inches in width. Existing emergency back-up generator measure thirteen (13) feet six (6) inches in length, five (5) feet in width and five (5) feet eight (8) inches in height.
The location of said privilege shall be as shown on prints kept on file with the Department of Business Affairs and Consumer Protection and the Office of the City Clerk.
Said privilege shall be constructed in accordance with plans and specifications approved by the Department of Transportation (Division of Project Development).
This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions of the Municipal Code of Chicago.
The grantee shall pay to the City of Chicago as compensation for the privilege #1106298 herein granted the sum of two thousand five hundred ($2,500.00) per annum in advance.
A 25% penalty will be added for payments received after due date.
The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.
Authority herein given and granted for a period of five (5) years from anitafter 05/14/2013.
