Dear Property Owner:

In accordance with the requirements for an Amendment to the Chicago Zoning Ordinance, specifically Section 17-13-0107, please be informed that on or about April 27, 2018, the undersigned will file an application for a change in zoning from RT-4 to B1-1 on behalf of the Sivananda Yoga Vedanta Center for the property located at 1246 W. Bryn Mawr Avenue.

The applicant intends to continue using the subject property as a yoga center, meditation hall, temple and residence for the Center Director, the same use to which the property has been put since the applicant acquired it in 1972. The reason for the rezoning is to enable the applicant to obtain a limited business license for incidental retail sales of books, devotional items and yoga accessories in a small gift shop which will be located on the second floor of the property. After the business license is obtained, zoning for the property will revert to RT-4. There are no changes being sought to the building or construction occurring on the premises.

The contact person for Center is Robyn Hennon, whose address is 1246 W. Bryn Mawr Avenue, Chicago, IL 60660. Ms. Hennon's phone number is 773-878-7771. The owner of the subject property is the Sivananda Yoga Vedanta Centre, a Canadian not-for-profit corporation pursuant to the Canadian Income Tax Act, located in Val-Morin in Quebec, Canada.

I am the attorney for the applicant and the contact person for this application. My address is 111 W. Washington, Suite 1920, Chicago, Illinois 60602 and I can be contacted at 312-750-9272.
Yours truly, Thomas J. Murphy

Please note that the applicant is not seeking to purchase or rezone your property. The applicant is required by law to send this letter to property owners within 250 feet of his proposed project.

Re Zoning Amendment for the property located at 1246 W. Bryn Mawr

The undersigned, Thomas J. Murphy, being first duly sworn on oath, deposes and states the following:

The undersigned certifies that he has complied with the requirements of Section 17-13-0107 of the Chicago Zoning Ordinance, by sending written notice to such property owners who appear to be the owners of all property within the subject area not solely owned by the applicant, and to the owners of all property within 250 feet in each direction of the lot line of the subject property, exclusive of public roads, streets, alleys and other public ways, or a total distance limited to 400 feet. Said "written notice" was sent by First Class U.S. Mail, no more than 30 days before filing the application.

The undersigned certifies that the notice contained the address of the property sought to be rezoned; a statement of the intended use of the property; the name and address of the applicant; the name and address of the owner; and a statement that the applicant intends to file the application for a change in zoning on approximately April 27, 2018.

The undersigned certifies that the applicant has made a bona fide effort to determine the addresses of the parties to be notified under Section 17-13-0107 of the Chicago Zoning Ordinance, and that the accompanying list of names and addresses of surrounding property owners within 250 feet of the subject site is a complete list containing the names and addresses of the people required to be served.

Dear Sir or Madam
This letter is in response to your request for a copy of your organization's determination letter. This letter will take the place of the copy you requested.
Our records indicate that a determination letter issued in June 1992, granted your organization exemption from federal income tax under section 501(c)(3) of the Internal Revenue Code. That letter is still in effect
Based on information subsequently submitted, we classified your organization as one that is not a private foundation within the meaning of section 509(a) of the Code because it is an organization described in section 509(a)(2).
This classification was based on the assumption that your organization's operations would continue as stated in the application If your organization's sources of support, or its character, method of operations, or purposes have changed, please let us know so we can consider the effect of the change on the exempt status and foundation status of your organization.
Your organization is required to file Form 990, Return of Organization Exempt from Income Tax, only if its gross receipts each year are normally more than S25.000 If a return is required, it must be filed by the 15th day of the fifth month after the end of the organization's annual accounting period. The law imposes a penalty of S20 a day, up to a maximum of $10,000. when a return is filed late, unless there is reasonable cause for the delay.
All exempt organizations (unless specifically excluded) are liable for taxes under the Federal Insurance Contributions Act (social security taxes) on remuneration of S100 or more paid to each employee during a calendar year. Your organization is not liable for the tax imposed under the Federal Unemployment Tax Act
