ORDINANCE WALMART # 5645 Acct. No 303471 - 9 Permit No. 1132613
.Be It Ordained by the City Council of the City of Chicago.
SECTION 1. Permission and authority are hereby given and granted to WALMART # 5645, upon the terms and subject to the conditions of this ordinance to maintain and use, as now constructed, three (3) Occupation of Spaces (Mechanical Chase) on the public right-of-way adjacent to its premises known as 2826-2870 N. Broadway. Mechanical chase will be used to allow mechanical elements to pass from one space to another in the building
Said Occupation of Space(s) at Public Alley-South measure(s):
One (1) at seven point two five (7.25) feet in length, and point eight three (.83) feet in width for a total of six point zero two (6.02) square feet. Mechanical chase shall be fourteen (14) feet three (3) inches above grade level.
One (1) at two point five (2 5) feet in length, and two point five (2.5) feet in width for a total of six point two five (6.25) square feet. Mechanical chase shall be fourteen (14) feet one (1) inch above grade level
One (1) at thirty-six point four one (36.41) feet in length, and three (3) feet in width for a total of one hundred nine point two three (109.23) square feet. Mechanical chase shall be sixteen (16) feet above grade level. The location of said privilege shall be as shown on prints kept on file with the Department of Business Affairs and Consumer Protection and the Office of the City Clerk.
Said privilege shall be constructed in accordance with plans and specifications approved by the Department of Planning and Development, Department of Transportation (Division of Project Development), and Department of Transportation (Office of Underground Coordination).
This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions of the Municipal Code of Chicago.
The grantee shall pay to the City of Chicago as compensation for the privilege #1132613 herein granted the sum of one thousand two hundred ($1,200.00) per annum in advance
A 25% penalty will be added for payments received after due date.
The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.

An ordinance has been prepared by the Department of Business Affairs and Consumer Protection - Small Business Center - Public Way Use Unit for presentation to the City Council.
