SUBSTITUTE RESOLUTION
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. The Rules of Order and Procedure of the City Council, City of Chicago, for the 2019 — 2023 term are hereby amended by deleting the language struck through, and: by inserting the language underscored, as follows:
Public Participation.
RULE 58, Any member ofthe general public may address orally, in person orfrom a remote location by means of a video, audio, telephonic or other electronic connection,-or in writing any committee of, or meeting of. the City Council at any meeting required to be open to the public under the Open Meetings: Act (5 ILCS 120/1, et seq.); provided that oral public comment at meetings of the City Council shall be subject to the time limits set forth below. Any person who orally addresses a committee of, or meeting of, the City Council shall:
(1) be physically present insido tho assembly: room whero the meriting' takes placo;
(24 limit his or her their remarks to three minutes, and if the person intends to address more than one item, use that time, at the Chairman's direction, to address one, or several, such items;
(3 2) iimit bis-or her their remarks to the subject matter appearing on the agenda of the meeting;
(4 3) refrain from profane language, obscene conduct; or disruptive comments;
(§ 4) submit his or her requestto speak.pursuant to a protocol promulgated by the Sergeant-at-Arms; and " ■
($5) comply with the order ofthe Chairman ofthe meeting.
Any person who submits written comments shall do so in conformity with the applicable provisions of the Sergeant-at-Arms' protocol.
The Chairman of the meeting has authority and discretion to: (i) curtail or limit public comment if -the commenter fails to comply with this Rule, and (ii) allow reasonable variances fromthe three-minute time limit in appropriate, non-discriminatory, circumstances. Public comment at meetings* of the City Council, except for the City Council meeting that includes the annual public hearing on the.budget, shall be limited to a total of 30 minutes.

Remote Meetings Pursuant to Disaster Declarations.
RULE 59. All public meetings of the City Council and its committees snail may, be conducted remotely by means of electronic, video, audio, op telephonies other electronic connection ("remote meeting").in accordance with subsection (e)-6f Section 7 of the Open Meetings Act, codified at5 ILCS 12077(e). A member who doeires to attend-and participate in a public meeting shalf-do so by means of a remote, meeting. A member who attends a remote meeting is considered present for purposes of Rule 19.
For purposes of conducting a remote meeting, the terms "written", "in writing", "document" and "copy" in these fules Rules of Order and Procedure includes printed or electronic means, and a rule that requires an instrument to be handed lo another member or the Presiding Officer may be accomplished by electronic transmission.
If, during a .disaster declaration, the City Council or any of its committees holds an in--person meeting instead of a remote meeting as allowedMn this Rule, the Clerk and;Sergeant-at-Arms are authorized to determine the location from which anv member of the general public may address the Citv-Councifor.any of its committees at such a meeting in order to protect the health and safety of the public.
To the extent of any inconsistency between this Rule and anv other provision of these Rules of Order and Procedure, this Rule shall prevail. .
SECTION 2.: On ApriH 15, 2020, the City Council of the City of Chicago passed a resolution, referenced as R2020-234, published on page 14970 of the Journal of the Proceedings of the City Council of the City of Chicago of that date, amending the Rules of Order and Procedure ofthe City Council, City of Chicago, for the 2019 — 2023 term ("Rules Resolution"). SECTION 2 of the Rules Resolution is hereby repealed in its entirety.
