Be It Ordained by the City Council of the City of Chicago:
SECTION 1. Permission and authority are hereby given and granted to THE MORGAN AT LOYOLA STATION, upon the terms and subject to the conditions of this ordinance to maintain and use, as now constructed, fourteen (14) Foundation Support(s) (footing) under the public right-of-way adjacent to its premises known as 1209 W. Arthur Ave
Said Foundation Support(s) at N. Sheridan measure(s):
Three (3) at seven point six six (7.66) feet in length and one point six six (1.66) foot in width for a total of thirty-eight point one five (38.15) square feet.
Said Foundation Support(s) at W. Arthur measure(s):
One (1) at nine (9) feet in length and two point three three (2.33) feet in width for a total of twenty point nine seven (20.97) square feet.
Said Foundation Support(s) at W. Arthur measure(s):
One (1) at seven point six six (7.66) feet in length and one point six six (1.66) foot in width for a total of twelve point seven two (12.72) square feet.
Said Foundation Support(s) at W. Arthur measure(s):
One (1) at six (6) feet in length and one point three three (1.33) foot in width for a total of seven point nine eight (7.98) square feet.
Said Foundation Support(s) at W. Arthur measure(s):
One (1) at seven point six six (7.66) feet in length and one (1) foot in width for a total of seven point six six (7.66) square feet.

Said Foundation Support(s) at Public Alley measure(s):
One (1) at two hundred thirty-seven point two five (237.25) feet in length and one (1) foot in width for a total of two hundred thirty-seven point two five (237.25) square feet.
Said foundation support shall be located under the sidewalk along North Sheridan Road West Arthur Avenue and the public alley approximately three (3) to ten (10) feet below grade level.
Said privilege shall be constructed in accordance with plans and specifications approved by the Office of Emergency Mgmt and Communications, Office of Underground Coordination, and Planning Department
This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions of the Municipal Code of Chicago.
The grantee shall pay to the City of Chicago as compensation for the privilege #1132846 herein granted the sum of four hundred ($400.00) per annum in advance.
A 25% penalty will be added for payments received after due date.
The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.
Authority herein given and granted for a period of five (5) years from and after 03/12/2013.

Dear Alderman Joe Moore:
The applicant referenced above has requested the use of the public right-of-way for a foundation support(s). An ordinance has been prepared by the Department of Business Affairs and Consumer Protection - Small Business Center - Public Way Use Unit for presentation to the City Council. Because this request was made for properties located in your ward, as approved by you as per the attached, I respectfully request that you introduce the attached ordinance at the next City Council meeting.
