EXECUTIVE ORDER NO. 2021-4
WHEREAS, the City of Chicago ("City") is a home rule municipality as described in Section 6(a), Article VII ofthe 1970 Constitution of the State of Illinois, and as such may exercise any power and perform any function pertaining to its government and affairs, including protecting the public health, safety, and welfare of its citizens; and
WHEREAS, as a consequence of the ongoing COVID-19 pandemic, global supply chains and shipments have slowed, causing worldwide shortages; and
WHEREAS, in November 2021, the annual rate of inflation in the United States reached 6.8%, the largest 12-month increase since the period ending June 1982, as measured by the Consumer Price Index; and
WHEREAS, the global supply chain crisis has disrupted the procurement of certain materials and supplies that the City relies on to provide critical services to the residents ofthe City; and
WHEREAS, under Section 2-4-110 ofthe Municipal Code of Chicago ("Code"), the Mayor is ex officio coordinator of activities in cases of emergency requiring concerted measures for the maintenance of public peace and order, and the preservation of life and property; and
WHEREAS, the Mayor is further authorized to execute plans for the prevention of emergencies so far as possible and for meeting them effectively when they arise, and City departments, officers, and employees are required to comply with the Mayor's orders in executing emergency plans and meeting such emergencies; and
WHEREAS, it is essential that City government be abie to act swiftly and effectively to provide essential services to the City's residents during the operational emergency caused by the global supply chain crisis and during the public health emergency caused by COVID-19 and; and
WHEREAS, the City government cannot risk any further delay or uncertainty in its ability to procure certain essential materials and supplies; now, therefore,
I, LORI E. LIGHTFOOT, Mayor ofthe City of Chicago do hereby order as follows:
SECTION 1. Pursuant to Section 2-4-110 of the Code, I hereby declare that an operational emergency exists in the City due to the global supply chain crisis.
SECTION 2. Notwithstanding any inconsistent Code provision, the Chief Procurement Officer is authorized to negotiate and execute contracts, and to make modifications to existing contracts, forthe provision of any particular good, work, or service to address the emergency, up to $1,000,000.00 for each such contract or modification, which contract shall include terms that the Chief Procurement Officer deems necessary or appropriate to effectively address the emergency. The Chief Procurement Officer shall place on file with the City Council Committee
on the Budget and Government Operations a report of all contracts awarded and modifications made pursuant to this Order.
SECTION 3. This Order shall be repealed of its own accord upon the passage and approval of an ordinance that contains the authorizations for thc Chief Procurement Officer that are embodied in this Order.
SECTION 4. This Order shall take effect upon its execution and filing with the City
Clerk.
