Be It Ordained by the City Council ofthe City of Chicago:

SECTION 1. Permission and authority are hereby given and granted to M & R DEVELOPMENT LLC, upon the terms and subject to the conditions of this ordinance to maintain and use, as now constructed, fifteen (15) Caisson(s) under the public right-of-way adjacent to its premises known as 73 E. Lake St

Said Caisson(s) at N. Wabash and E. Lake measure(s):

One (1) at seven point seven five (7.75) feet in length, and four point six two (4.62) feet in width for a total of thirty-five point eight one (35.81) square feet.

One (1) at two point eight (2.8) feet in length, and eight point seven five (8.75) feet in width for a total of twenty-four point five (24.5) square feet.

One (1) at two point eight three (2.83) feet in length, and two point two (2.2) feet in width for a total of six point two three (6.23) square feet.

One (1) at two point two eight (2.28) feet in length, and seven point three five (7.35) feet in width for a total of sixteen point seven six (16.76) square feet.

One (1) atone point eight three (1.83) foot in length, and six point five five (6.55) feet in width for a total of eleven point nine nine (11.99) square feet.

One (1) at two point nine two (2.92) feet in length, and ten point two eight (10.28) feet in width for a total of thirty point zero two (30.02) square feet.

One (1) at two point nine two (2.92) feet in length, and eleven point one nine (11.19) feet in width for a total of thirty-two point six seven (32.67) square feet.

One (1) at two point eight three (2.83) feet in length, and ten point nine five (10.95) feet in width for a total of thirty point nine nine (30.99) square feet.

One (1) at two point seven (2.7) feet in length, and ten point eight three (10.83) feet in width fora total of twenty-nine point two four (29.24) square feet.

One (1) at one point five (1.5) foot in length, and five point five (5.5) feet in width for a total of eight point two five (8.25) square feet.

One (1) at two point three three (2.33) feet in length, and nine point zero six (9.06) feet in width for a total of twenty-one point one one (21.11) square feet.

The location of said privilege shall be as shown on prints kept on file with the Department of Business Affairs and Consumer Protection and the Office of the City Clerk.

Said privilege shall be constructed in accordance with plans and specifications approved by the Department of Planning and Development and Department of Transportation (Office of Underground Coordination).

This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions of the Municipal Code of Chicago.

The grantee shall pay to the City of Chicago as compensation for the privilege #1136879 herein granted the sum of four hundred ($400.00) per annum in advance.

A 25% penalty will be added for payments received after due date.

The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.
