PUBLIC ALLEY OPENING
WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) of the 1970 constitution of the State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the City can enhance utility placement and public access by opening new rights of way or widening existing rights of way ("Opening"); and
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. AN ALLEY OPENING OF THE PORTION OF THE LOTS DESCRIBED AS THOSE PARTS OF LOTS 2 AND 3 IN CHICAGO INDUSTRY TECH PARK III, BEING A SUBDIVISION IN THE SOUTH FRACTIONAL HALF OF SECTION 18, TOWNSHIP 40 NORTH, RANGE 13 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS, ACCORDING TO THE PLAT THEREOF RECORDED NOVEMBER 1, 2010 AS DOCUMENT NUMBER 1030544015, MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE SOUTHWEST CORNER OF SAID LOT 3; THENCE NORTHERLY ALONG THE WEST LINE OF SAID LOT 3 ON A GRID BEARING OF THE ILLINOIS STATE PLANE COORDINATE SYSTEM OF NORTH 01 DEGREES 58 MINUTES 55 SECONDS WEST AND RECORDED AS NORTH 00 DEGREES 25 MINUTES 50 SECONDS WEST, A DISTANCE OF 83.09 FEET TO THE POINT OF CURVATURE OF A CURVE, CONCAVE WESTERLY, HAVING A RADIUS OF 2437.50 FEET, AND A CENTRAL ANGLE OF 13 DEGREES 27 MINUTES 19 SECONDS; THENCE NORTHERLY ALONG SAID WEST LINE AND SAID CURVE A DISTANCE OF 572.42 FEET TO THE POINT OF BEGINNING OF SAID EASEMENT; THENCE NORTH 88 DEGREES 16 MINUTES 12 SECONDS EAST A DISTANCE OF 56.87 FEET ALONG A LINE 50 FEET SOUTH OF AND PARALLEL WITH A LINE RECORDED AS 733.00 FEET NORTH OF THE SOUTH LINE OF THE SOUTHWEST 1/4 OF SAID SECTION 18; THENCE NORTH 02 DEGREES .03 MINUTES 33 SECONDS WEST A DISTANCE OF 484.87 FEET ALONG A LINE PARALLEL WITH AND 40 FEET EAST OF A WEST LINE OF SAID LOT 2; THENCE SOUTH 58 DEGREES 28 MINUTES 49 SECONDS WEST A DISTANCE OF 45.94 FEET TO THE RECORDED NORTH-SOUTH CENTERLINE OF SAID SECTION, SAID LINE ALSO BEING A WEST LINE OF SAID LOT 2; THENCE SOUTH 02 DEGREES 03 MINUTES 33 SECONDS EAST, ALONG SAID LINE, A DISTANCE OF 412.04 FEET TO A CORNER OF SAID LOT 3, SAID CORNER BEING ON A LINE 733 FEET NORTH OF THE SOUTH LINE OF SAID SOUTHWEST QUARTER SECTION; THENCE SOUTH 88 DEGREES 16 MINUTES 12 SECONDS WEST A DISTANCE OF 29.44 FEET TO THE WEST LINE OF SAID LOT 3, SAID LINE BEING ON A CURVE CONCAVE

WESTERLY WHOSE RADIUS IS 2437.50 FEET; THENCE SOUTHERLY ALONG AN ARC OF SAID CURVE A DISTANCE OF 51.63 FEET THROUGH A CENTRAL ANGLE OF 01 DEGREES 12 MINUTES 49 SECONDS TO THE POINT OF BEGINNING. CONTAINING 0.46 ACRES OR 20,091 SQUARE FEET, MORE OR LESS as shaded and legally described by the words "ALLEY HEREBY OPENED" on the Plat hereto attached as Exhibit A, which plat for greater certainty, is hereby made a part of this ordinance, be and the same is hereby opened, as the same is intended for public use and the public interest will be subserved by such Opening.
SECTION 2. The alley Opening herein provided for is made upon the express condition that within one hundred eighty (180) days after the passage of this ordinance, the Chicago Department of Transportation Division of Engineering shall file or cause to be filed for record in the Office of the Recorder of Deeds of Cook County, Illinois a certified copy of this ordinance, together with the full sized corresponding plat as approved by the Chicago Department of Transportation's Acting Superintendent of Maps and Plats.
SECTION 3. This ordinance shall take effect and be in force from and after its passage and publication. The Opening shall take effect upon its recording.
