Be It Ordained by the City Council of the City of Chicago:
SECTION 1. Permission and authority are hereby given and granted to 71 S. WACKER DR LLC, upon the terms and subject to the conditions of this ordinance to maintain and use, as now constructed, five (5) Earth Retention System(s) under the public right-of-way adjacent to its premises known as 71 S. Wacker Dr
Said Earth Retention System(s) at W. Monroe Street measure(s):
One (1) at forty-nine point five (49.5) feet in length, and two point three three (2.33) feet in width for a total of one hundred fifteen point three four (115.34) square feet. Existing earth retention system is located approximately fourteen (14) feet six (6) inches below grade and the maximum depth is forty-nine (49) feet six (6) inches below grade.
Said Earth Retention System(s) at S. Franklin Street measure(s):
Three (3) at six (6) feet in length, and one (1) foot in width for a total of eighteen (18) square feet. Existing earth retention systems are located approximately fourteen (14) feet six (6) inches below grade and the maximum depth is forty-nine (49) feet six (6) inches below grade.
Said Earth Retention System(s) at W. Arcade Place measure(s):
One (1) at two hundred twenty-four (224) feet in length, and three (3) feet in width for a total of six hundred seventy-two (672) square feet. Existing earth retention system is approximately fourteen (14) feet six (6) inches below grade and the maximum depth is forty-nine (49) feet six (6) inches below grade.
The location of said privilege shall be as shown on prints kept on file with the Department of Business Affairs and Consumer Protection and the Office of the City Clerk.
Said privilege shall be constructed in accordance with plans and specifications approved by the Department of Transportation (Office of Underground Coordination).
This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions of the Municipal Code of Chicago.
the grantee shall pay to the City of Chicago as compensation for the privilege #1122980 herein granted the sum of one thousand seven hundred fifty-nine ($1,759.00) per annum in advance.
A 25% penalty will be added for payments received after due date.
The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.
