Be It Ordained by the City Council of the City of Chicago:

SECTION 1. Permission and authority are hereby given and granted to MB 1001 LLC, upon the terms and subject to the conditions of this ordinance to construct, install, maintain and use fifteen (15) Planter(s) on the public right-of-way for beautification purposes adjacent to its premises known as 738 N. Morgan St

Said Planter(s) at W. Chicago Avenue measure(s):

One (1) at forty-one point one six (41.16) feet in length, and seven (7) feet in width for a total of two hundred eighty-eight point one two (288.12) square feet.

Two (2) at forty-six point two five (46.25) feet in length, and seven (7) feet in width for a total of six hundred forty-seven point five (647.5) square feet.

Said Planter(s) at N. Morgan Street measure(s):

One (1) at thirty-six (36) feet in length, and six point three three (6.33) feet in width for a total of two hundred twenty-seven point eight eight (227.88) square feet.

Three (3) at fourteen (14) feet in length, and six point three three (6.33) feet in width for a total of two hundred sixty-five point eight six (265.86) square feet.

Said Planter(s) at N. Carpenter Street measure(s):

One (1) at eleven point nine two (11.92) feet in length, and six point five (6.5) feet in width for a total of seventy-seven point four eight (77.48) square feet.

One (1) at thirty-five point six seven (35.67) feet in length, and six point five (6.5) feet in width for a total of two hundred thirty-one point eight six (231.86) square feet.

One (1) at thirty-six point three three (36.33) feet in length, and six point five (6.5) feet in width for a total of two hundred thirty-six point one five (236.15) square feet.

Two (2) at forty (40) feet in length, and six point five (6.5) feet in width for a total of five hundred twenty (520) square feet.

One (1) at fourteen (14) feet in length, and six point five (6.5) feet in width for a total of ninety-one (91) square feet. One (1) at sixteen (16) feet in length, and six point five (6.5) feet in width fora total of one hundred four(104) square feet.

One (1) at forty-two point five eight (42.58) feet in length, and six point five (6.5) feet in width for a total of two hundred seventy-six point seven seven (276.77) square feet.

Grantee must allow the required clear and unobstructed space for pedestrian passage at all times per rules and regulations approved by the Department of Transportation.

The location of said privilege shall be as shown on prints kept on file with the Department of Business Affairs and Consumer Protection and the Office of the City Clerk.

Said privilege shall be constructed in accordance with plans and specifications approved by the Department of Planning and Development and Department of Transportation (Division of Project Development).

This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions of the Municipal Code of Chicago.

The grantee shall pay to the City of Chicago as compensation for the privilege #1121710 herein granted the sum of zero ($.00) per annum in advance.

A 25% penalty will be added for payments received after due date.

The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.

Authority herein given and granted for a period of five (5) years from and after Date of Passage.
