ORDINANCE

WRIGLEY FIELD HOLDINGS, LLC Acct. No. 349514 -4 Permit No. 1146729

 

Be It Ordained by the City Council of the City of Chicago:

SECTION 1. Permission and authority are hereby given and granted to WRIGLEY FIELD HOLDINGS, LLC, upon the terms and subject to the conditions of this ordinance to maintain and use, as now constructed, ninety (90) Conduit(s) under the public right-of-way adjacent to its premises known as 3709 N. Clifton Ave

Said Conduit(s) at N. Clifton Avenue measure(s):

Ten (10) at fifty-two (52) feet in length, and three (3) feet in width for a total of one thousand five hundred sixty (1560) square feet.

Nine (9) at forty-eight (48) feet in length, and three (3) feet in width for a total of one thousand two hundred ninety-six (1296) square feet.

Thirty (30) at forty-eight (48) feet in length, and five point four one (5.41) feet in width for a total of seven thousand seven hundred ninety point four (7790.4) square feet.

Nine (9) at ten (10) feet in length, and two (2) feet in width for a total of one hundred eighty (180) square feet. Twenty-four (24) at ten (10) feet in length, and two (2) feet in width for a total of four hundred eighty (480) square feet.

Two (2) at ten (10) feet in length, and point eight three (.83) feet in width fora total of sixteen point six (16.6) square feet.

Four (4) at ten (10) feet in length, and two point four one (2.41) feet in width for a total of ninety-six point four (96.4) square feet.

Two (2) at sixty-six (66) feet in length, and one point four one (1.41) foot in width fora total of one hundred eighty-six point one two (186.12) square feet.

The location of said privilege shall be as shown on prints kept on file with the Department of Business Affairs and Consumer Protection and the Office of the City Clerk.

Said privilege shall be constructed in accordance with plans and specifications approved by the Department of Transportation (Division of Project Development) and Department of Transportation (Office of Underground Coordination)

This grant of privilege in the public way shall be subject to the provisions of Section 10-28-015 and all other required provisions of the Municipal Code of Chicago.

The grantee shall pay to the City of Chicago as compensation for the privilege #1146729 herein granted the sum of seventeen thousand four hundred eighty-four ($17,484.00) per annum in advance.

A 25% penalty will be added for payments received after due date.

The permit holder agrees to hold the City of Chicago harmless for any damage, relocation or replacement costs associated with damage, relocation or removal of private property caused by the City performing work in the public way.

Dear Alderman Thomas Tunney:

The applicant referenced above has requested the use of the public right-of-way for a conduit(s). An ordinance has been prepared by the Department of Business Affairs and Consumer Protection - Small Business Center - Public Way Use Unit for presentation to the City Council. Because this request was made for properties located in your ward, as approved by you as per the attached, I respectfully request that you introduce the attached ordinance at the next City Council meeting.
