RESOLUTION
WHEREAS, on March 18, 2020, Mayor Lori Lightfoot executed Executive Order 2020-01 which declared a public health emergency caused by the coronavirus pandemic and granted her broad and extraordinary powers during the emergency (the "Executive Order");
WHEREAS, among other powers granted in the Executive Order, the Executive Order authorized the City's Chief Procurement Officer to negotiate and execute contracts for emergency supplies and services up to $1,000,000.00 for each such contract, which contract shall include terms that the Chief Procurement Officer deems necessary or appropriate to effectively address the Emergency;
WHEREAS, among other powers granted in the Executive Order, the Executive Order authorized the City's Budget Director to establish new funding lines, consolidate funding lines, and transfer or otherwise reallocate currently appropriated funds, including making fund transfers between City Departments;
WHEREAS, among other powers granted in the Executive Order, the Executive Order authorized the Commissioner of Assets, Information and Services to enter into temporary agreements for the use and occupancy of real property and to provide indemnification in such agreements;
WHEREAS, it is the purview and legal responsibility of the City Council to approve and authorize appropriations by the City, to pass a balanced budget and to protect the fiscal integrity ofthe City;
WHEREAS, the Executive Order fails to include the oversight or approval of the Chicago City Council in any ofthe aforementioned authorizations and due to such failure, violates the City of Chicago Municipal Code in a myriad of ways;
NOW, THEREFORE, we, the members ofthe Chicago City Council hereby resolve to pass this resolution requiring as follows:
The City's Chief Procurement Officer, the City's Budget Director and the City's Commissioner of Assets, Information and Services shall, within fourteen (14) days of the passage ofthis resolution, appear before the City Council's Budget Committee for a hearing on this resolution;
At that appearance before the Budget Committee, the City's Chief Procurement Officer shall provide a list of the contracts which have been exercised under the authority granted by the Executive Order and the contracts anticipated to be executed while the Executive Order remains in place, and such list shall include the date or anticipated date of each contract's execution, the amount and duration of each contract, and a general description of each contract's purpose;

At that appearance before the Budget Committee, the City's Chief Budget Director shall provide information detailing all such action taken pursuant to the Executive Order any action anticipated to be taken while the Executive Order remains in place, including identification of new funding lines, consolidation of funding lines, and transfer or otherwise reallocation of currently appropriated funds, including fund transfers between City Departments;
At that appearance before the Budget Committee, the Commissioner of Assets, Information and Services shall provide a list of all temporary agreements for the use and occupancy of real property entered into pursuant to the authority granted in the Executive Order and agreements anticipated to be entered into while the Executive Order remains in place and shall include a description ofthe indemnification language contained in such agreements;
The City's Chief Procurement Officer, the City's Budget Director and the City's Commissioner of Assets, Information and Services shall also be prepared to discuss the ramifications of the emergency on the City's finances and budget, including anticipated shortfalls in revenue, increases in expenses, and need for additional revenue raising measures like bond issuances, asset sales and draws on line(s) of credit.
