ORDINANCE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. Section 4-60-140 of the Municipal Code of Chicago is hereby amended by inserting the language underscored, as follows:

4-60-140 Prohibited activities.

(k)     No holder of a package goods license shall sell or otherwise provide to customers disposable cups that have been removed from their bulk packaging and are empty or contain only ice. For purposes of this subsection only, the term "disposable cup" means any drinking receptacle made of paper, plastic, stvrofoam, or similar material, that is designed and intended to be disposed of after use. This subsection does not prohibit (1) the provision of empty disposable cups that are intended to be filled by the customer from an on-site self-serve dispenser in order to purchase soda, coffee, or other nonalcoholic beverage; (2) the sale of bulk packages of disposable cups; or (3) the sale of packaged or unpackaged non-disposable cups, such as coffee cups, travel mugs, and drinking glasses.
