ORDINANCE

WHEREAS, the City of Chicago ("City") is a home rule unit of government by virtue of the provisions of the Constitution of the State of Illinois of 1970, and, as such, may exercise any power and perform any function pertaining to its government and affairs; and

WHEREAS, pursuant to ordinance ("Vacation Ordinance") adopted by the City Council of the City of Chicago (the "City Council"), on October 31, 1984, and published in the Journal of the Proceedings of the City Council (the "Journal") for such date at pages 10677 through 10679, the City Council approved the vacation of a portion of that certain alley and a portion of West Carroll Avenue, each as legally described in Section 1 of the Vacation Ordinance, to LaSalle National Bank, as trustee of trust number 104102 ("Trustee 104102"); and

WHEREAS, such vacation was conditioned, in part, on Trustee 104102, or its successors or assigns, recording: (a) a grant of easement for a strip of land 24 feet in width over, upon and across the right of way of Carroll Avenue as vacated in the Vacation Ordinance, to remain open above the existing grade (at track level) and below an elevation of 18 feet above the existing grade for (i) public ingress and egress, (ii) installation, maintenance, removal and operation of public water and sewer lines, and (iii) installation, maintenance, removal, and operation of railroad tracks by the Chicago and North Western Transportation Company, its successors and assigns; and (b) a grant of easement to the City for pedestrian ingress and egress, over, upon and across an area of not less than 25,000 square feet in the aggregate, both along the Chicago River and above the improvements to be constructed over a to-be-established vehicular ingress and egress easement; and

WHEREAS, Trustee 104012 subsequently caused a portion of West Carroll Street vacated by the Vacation Ordinance to be conveyed to LaSalle National Bank, as trustee, pursuant to trust no. 109495 ("Trustee 109495") (Trust...
