COMMERCIAL ORDINANCE
WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) of the 1970 constitution of the State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the properties located at 2235-39 W. 35th Street are owned by 2235-39 W. 35th Street, LLC, an Illinois limited liability company; and the properties located at 2241-2245 W. 35th Street are owned by Gilberto Zavala and Ana Zavala, (cumulatively and subsequently known as "The Adjacent Owners"; and
WHEREAS, The Adjacent Owners propose to use the portion of the alley to be vacated herein for extended playground and recreational space for the adjacent Montessori School; and homeowners respectively; and
WHEREAS, the City Council of the City of Chicago, after due investigation and consideration, has determined that the nature and extent ofthe public use and the public interest to be subserved is such as to warrant the vacation of part of public alley, described in the following ordinance; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. LEGAL DESCRIPTION: THAT PART OF THE 16 FOOT WIDE PUBLIC ALLEY LYING SOUTH OF AND ADJOINING THE SOUTH LINE OF LOTS 1, 2, 3, 4, AND 5; LYING WEST OF AND ADJOINING THE WEST RIGHT OF WAY LINE OF S. BELL AVENUE (FORMALLY KNOWN AS S. IRVING AVENUE); LYING EAST OF AND ADJOINING THE SOUTHERLY EXTENSION OF THE WEST LINE OF LOT 5; AND LYING NORTH OF AND ADJOINING THAT PART OF THE NORTHERLY LINES OF LOT 23, ALL INCLUSIVE, IN WESTON'S SUBDIVISION OF BLOCK 2 IN J.H. REE'S SUBDIVISION OF THE NORTHWEST 1/4, OF THE SOUTHWEST 1/4 OF SECTION 31, TOWNSHIP 39 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN, AS RECORDED FEBURARY 18, 1876 AS DOCUMENT NUMBER 72840, IN COOK COUNTY, ILLINOIS, CONTAINING 1953.1 SQ.
