ORDINANCE
Whereas, on street parking spaces are at a premium in many neighborhoods and their safe use is beneficial to the general welfare;
Whereas, the placement of fences and other landscape elements in the parkway requires a public way use permit;
Whereas, the placement of fences and other solid elements in the parkway near the curb limits the utilization of on street parking and can lead to door swing damage to vehicles; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO
SECTION 1: Section 10-28-010 Article I. General Requirements of the Municipal Code of Chicago is hereby amended by adding the language underlined, as follows:
10-28-031 Unlawful to place fence or other solid landscape element within two feet of street side face of curb
It shall be unlawful for anv person to place a fence or other solid landscape element in a
public parkway within two feet of the street side face of the curb. Anv person who violates this section shall be fined not less than S50.00 nor more than 5500.00 for each offense, and each day such offense shall continue shall constitute a distinct and separate offense.
