BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:


SECTION 1. Title 17 of the Municipal Code of Chicago, the Chicago Zoning Ordinance, is hereby amended by changing all of the RS3 Residential Single-Unit (Detached House) District symbols and indications as shown on Map Number 9-K in the area bounded by:

the public alley next north of and parallel to West Melrose Street; North Keeler Avenue; West Melrose Street; and a line 49.28 feet west of and parallel to North Keeler Avenue

to those of an RM5.5 Residential Multi-Unit District, and a corresponding use district is hereby established in the area above described.

SECTION 2. This ordinance shall be in force and effect from and after its passage and due publication.

The Project

3236-42 N. Keeler, LLC, an Illinois limited liability company, the owner of the subject site (the "Applicant"), is seeking to rezone the property at 3236-42 N. Keeler from RS 3 to RM 5.5 so that the underlying zoning can reflect the density of the existing land use on the site. The Applicant proposes to maintain the existing 10 dwelling units which are currently on the site, eight of which constitute a legal existing non-conforming use and two of which were later added by a previous owner in violation of the existing zoning, before the Applicant's acquisition of the subject site in 2013.

Besides the required rezoning from RS 3 to RM 5.5, the Applicant will need to seek a parking reduction. Parking reduction is provided under Mun. Code Section 17-13-1101-C, which provides: "The Zoning Board of Appeals is authorized to grant a variation reducing off-street parking requirements by...not more than 5 spaces or 20%, whichever is greater, in an RM5.5, RM6 or RM6.5 district when the building for which the variation is requested has been in lawful existence for 50 or more years."
