COMMERCIAL ORDINANCE
WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) of the 1970 Constitution of the State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the properties at 801-813 W. Lake Street, 170-172 N. Halsted Street, and 176-184 N. Halsted Street are owned by W-SF Goldfinger Owner VIII, LLC a Delaware limited liability company, licensed to transact business in Illinois ("Developer"); and
WHEREAS, the Developer proposes to use the portion of the alley (above a public easement) to be vacated herein for construction of a commercial development ("Development"); and
WHEREAS, the City Council of the City of Chicago, after due investigation and consideration, has determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of those portions of public alley, described in the following ordinance; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1.
THAT PART OF THE EAST-WEST 15 FOOT PUBLIC ALLEY LYING SOUTH OF AND ADJOINING LOTS 1 TO 3 INCLUSIVE IN CARPENTER'S ADDITION TO CHICAGO, BEING A SUBDIVISION OF THE SOUTHEAST QUARTER OF SECTION 8, TOWNSHIP 39 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN, RECORDED AUGUST 31, 1836, ANTE-FIRE, LYING NORTH OF AND ADJOINING THE NORTH LINE OF LOT 7 IN THE SUBDIVISION OF LOTS 6 TO 13 IN BLOCK 36 OF CARPENTERS ADDITION TO CHICAGO AFORESAID, LYING EAST OF THE NORTHERLY EXTENSION OF THE WEST LINE OF SAID LOT 7, AND LYING WEST OF A LINE DRAWN FROM THE NORTHEAST CORNER OF SAID LOT 7 TO THE SOUTHEAST CORNER OF SAID LOT 1, ALL IN COOK COUNTY, ILLINOIS SAID AREA CONTAINING 1804 SQUARE FTEET OR 0.0414 ACRES, MORE OR LESS as shaded and legally described by the words "HEREBY VACATED" on the plat hereto attached as Exhibit A, which plat for greater clarity, is hereby made a pa...
