COMMERCIAL VACATION & DEDICATION ORDINANCE
WHEREAS, the City of Chicago ("City") is a hpnrie rule unit of local government pursuant to Article VII, Section 6 (a) of the 1970 Constitution of the State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the properties at 2100-2118 S. Sawyer Avenue and 2117-2127 S. Spaulding Avenue are owned by Chicago Title Land Trust as Trustee under Trust Agreement dated Novembers, 2019, and known as Trust 8002382184 ("Developer"); and
WHEREAS, the Developer proposes to use the portion of the alley to be vacated herein for assembling its surrounding lots, and fencing to secure the adjacent property; and '
WHEREAS, the City Council of the City of Chicago, after due investigation and consideration, has determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the dedication of a new public alley turn around area and the vacation of a portion of an existing dead-ended public alley, each as described below; now therefore, :
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. The Commissioner of the Chicago Department of Transportation (the "Commissioner"), or any ofthe Commissioner's designees, is each hereby authorized and directed to approve a dedication of certain property owned by the Developer, for use as public way, as shaded and identified by the words "HEREBY DEDICATED" on the plat hereto attached as Exhibit A, which plat for greater certainty is hereby made a part of this ordinance, and legally described below, as the same is intended for public use and the public, interest wjll be subserved by such dedication:
