At the request of the Commissioner of Planning and Development, I transmit herewith ordinances authorizing the sale of city-owned property.

ORDINANCE
WHEREAS, the City of Chicago ("City") is a home rule unit of government by virtue of the provisions of the Constitution of the State of Illinois of 1970, and as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the City is the owner of the parcel of property located at 2600 W. Madison Street (rear), Chicago, Illinois (the "City Property"), which City Property is located in the Midwest Redevelopment Project Area established pursuant to ordinances adopted by the City Council of the City (the "City Council") on May 17, 2000, and published in the Journal of Proceedings of the City Council (the "Journal") for such date at pages 30775 through 30953, and amended pursuant to ordinance adopted by the City Council on May 9, 2012, and published in the Journal for such date at pages 25884 through 26069; and
WHEREAS, JIH West, LLC, an Illinois limited liability company ("JIH West"), with its principal place of business at 1350 W. Madison Street, Chicago, IL 60607, is the owner of real property located at 2600 W. Madison Street (front), Chicago, Illinois ("JIH West Property"), upon which Johnny's Ice House West, an indoor ice hockey arena (the "Building") sits; and
WHEREAS, the JIH West Property is located adjacent to the City Property; and
WHEREAS, due to a JIH West's architect's error and without the City's consent, JIH West constructed the Building upon a 67 foot portion ("Encroachment") of the City Property, as legally described on Exhibit A attached hereto, and as shown in the ALTA survey ("Survey"), attach...
