COMMERCIAL ORDINANCE
WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) of the 1970 constitution of the State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the properties at 3358-3372 N. Avondale Avenue are owned by 3434 W. Henderson Building, LLC; and
WHEREAS, 3434 W. Henderson Building, LLC proposes to use the portion of the street to be vacated herein for parking; and
WHEREAS, the City Council of the City of Chicago, after due investigation and consideration, has determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of part of public street, described in the following ordinance; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. THAT PART OF NORTH AVONDALE AVENUE IN THE WEST 1/2 OF THE SOUTHEAST 1/4 OF SECTION 23, TOWNSHIP, 40 NORTH, RANGE 13, EAST OF THE THIRD PRINCIPAL MERIDIAN, DESCRIBED AS FOLLOWS:
BEGINNING AT THE POINT OF INTERSECTION OF THE SOUTHWESTERLY LINE OF NORTH AVONDALE AVENUE, AS OPENED BY DOCUMENT NUMBER 1185670 RECORDED NOVEMBER 15,1889, AND THE WEST LINE OF NORTH KIMBALL AVENUE; THENCE NORTH BVWMT WEST, ALONG THE SAID SOUTHWESTERLY LINE OF NORTH AVONDALE AVENUE, AS OPENED BY DOCUMENT NUMBER 1185670 RECORDED NOVEMBER 15,1889, A DISTANCE OF 184.43 FEET; THENCE NORTH Z8°2B'50" EAST, A DISTANCE OF 35.00 FEET; THENCE SOUTH 51°33'10" EAST, ALONG A LINE BEING PARALLEL TO THE SAID SOUTHWESTERLY LINE OF NORTH AVONDALE AVENUE, AS OPENED BY DOCUMENT NUMBER 1185670 RECORDED NOVEMBER 15,1889, A DISTANCE OF 156.64 FEET; THENCE SOUTH OO'OO'OO" WEST, A DISTANCE OF 44.69 FEET TO THE POINT OF BEGINNING, IN COOK COUNTY, ILLINOIS.
