COMMERCIAL ORDINANCE

WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) ofthe 1970 constitution ofthe State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and


WHEREAS, the properties at 500- 558 W. 59m Street, 501-559 and 500-558 W. 58tn Place, 400-454 W. 58th Place (vacated), 501-559, 500-558, 401-455, and 400-418 W. 58th Street, 501-545 W. 57th Place, 423-455 and 420-454 W. 57th Place, 5700-5756 S. Stewart Avenue, 5800-5830 S. Stewart Avenue, 5834-5844, 5848-5860, 5800-5830, 5801-5829, 5740-5742, 5746-5756, 5723-5725, and 5733 S. Normal Boulevard; 5733-5739, 5743-5747, and 5751-5757 S. Wallace Street are owned by Norfolk Southern Railway Company, a Virginia Corporation; and whereas the properties at approximately 5741, 5749, 5801, and 5821 S. Wallace Street, and 555 and 556 W. 58th Street are owned by The Commuter Rail Division ofthe Regional Transportation Authority, also known as METRA (CRD/RTA aka METRA); and


WHEREAS, Norfolk Southern Railway Company, a Virginia Corporation, proposes to use the portion of the streets and alleys to be vacated herein for the expansion of the Norfolk Southern Railway Company's 47th Street Intermodal Facility; and The Commuter Rail Division ofthe Regional Transportation Authority, also known as METRA proposes to annex the vacated rights of way to their adjacent lots; and


WHEREAS, the City Council of the City of Chicago, after due investigation and consideration, has determined that the nature and extent ofthe public use and the public interest to be subserved is such as to warrant the vacation of part of public streets and alleys, described in the following ordinance; now therefore,


BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:


SECTION 1.
PARCEL 1 (HEREBY VACATED TO NORFOLK SOUTHERN RAILWAY COMPANY, A VIRGINIA CORPORATION)
