PUBLIC STREET OPENING TO VEHICULAR TRAFFIC
WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) of the 1970 constitution of the State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the City can enhance public access by opening new rights of way or widening existing rights of way; and
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO: SECTION 1.
A NORTH-SOUTH STRIP OF LAND 66.00 FEET WIDE, LYING SOUTH OF AND ADJOINING THE SOUTH LINE OF N. NORMANDY AVENUE AS OPENED FOR PUBLIC STREET BY INSTRUMENT RECORDED APRIL 4, 2007 AS DOCUMENT 0709422019, AND LYING NORTH OF AND ADJOINING THE MOST NORTHERLY NORTH LINE OF LOT 3 IN CHICAGO INDUSTRY TECH PARK III PER DOCUMENT 1030544015, SAID STRIP OF LAND BEING MORE PARTICULARLY DESCRIBED AS THE WEST 66.00 FEET OF LOT 1 IN CHICAGO INDUSTRY TECH PARK III, BEING A SUBDIVISION IN THE SOUTH FRACTIONAL 1/2 OF SECTION 18, TOWNSHIP 40 NORTH, RANGE 13, EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED NOVEMBER 1, 2010 AS DOCUMENT 1030544015, IN COOK COUNTY, ILLINOIS (SAID PARCEL CONTAINING 1,312 SQUARE FEET OR 0.0301 ACRES, MORE OR LESS), as shaded and legally described by the words "HEREBY OPENED" on the Plat hereto attached as Exhibit A, which plat for greater clarity is hereby made a part of this ordinance, be and the same is hereby opened to vehicular traffic as the same is intended for public use, and the public interest will be subserved by such opening.
SECTION 2. The opening for public way herein provided for is made upon the express condition that the newly opened public street be constructed, in accordance with the most current version of the Chicago Department of Transportation's Regulations for Opening, Repair and Construction in the Public Way and its appendices, and in accordance with the executed Duty to Build Agreement attached herein and ma...
