ORDINANCE


WHEREAS, the City of Chicago (the "City") is a home rule unit of government under Article VII, Section 6(a) ofthe Constitution ofthe State of Illinois, and, as such, may exercise any power and perform any function pertaining to its government and affairs; and .,

WHEREAS, the City, through its Department of Planning and Development ("DPD"), desires to establish a 606 Bloomingdale Trail Neighborhood Area Neighborhood Improvement Program ("606 NIP Program") to fund improvements in a total amount not to exceed $1,000,000 to income-qualified, eligible single-family residential properties that are located within certain census tracts near the park and trail system generally known as the 606 Bloomingdale Trail, as more specifically set forth on Exhibit A, attached hereto (the "606 NIP Program Area"); and

WHEREAS, pursuant to Section 2-45-115(G)(1) ofthe Municipal Code of Chicago (the "Municipal Code"), certain funds derived from payments to the City pursuant to Sections 2-45-110 and 2-45-115 of the Municipal Code may be used for the construction, rehabilitation or preservation of affordable housing; and
WHEREAS, DPD desires to enter into an agreement with Neighborhood Housing Services of Chicago, Inc., an Illinois not-for-profit corporation ("NHS"), to perform certain administrative services for the 606 NIP Program (the "Agreement"); now, therefore,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. The above recitals are incorporated herein and made a part hereof.

SECTION 2. The 606 Bloomingdale Trail Neighborhood Area Neighborhood Improvement Program, as set forth in Exhibit B attached hereto and made a part hereof, is hereby authorized.
SECTION 3. NHS is hereby designated to administer the 606 NIP Program, subject to the supervision of DPD.

SECTION 4. Subject to the approval of the Corporation Counsel, and subject to the appropriation of funding, the Commissioner of DPD (the "Commissioner") and a designee of the Commissioner are each...
