ORDINANCE
WHEREAS, the City of Chicago is the owner of a portion of the public way commonly known as Palmer Boulevard depicted in Exhibit A ("Public Way");and
WHEREAS, the Public Way has historically served as public open space and a public park; and
WHEREAS, the City and the Chicago Park District have mutually determined that is it necessary and appropriate that the City permit Grantee to improve, operate and maintain the Public Way as a public open space and public park for a period of 99 years;
WHEREAS, the City of Chicago is an Illinois home rule municipality pursuant to Section 6(a) Article VII of the Illinois Constitution of 1970 and as such may exercise any power and perform any function related to its government and affairs; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. The Commissioner of Transportation is hereby authorized to execute an Agreement for Use of Public Way in substantially the form which is attached to and incorporated in this ordinance as Exhibit 1, subject to the approval of the Corporation Counsel as to form and legality. Further, the Commissioner is also authorized to execute such additional agreements and documents as are reasonably necessary or appropriate to implement this ordinance and the Agreement authorized hereby, subject to the approval of the Corporation Counsel.
SECTION 2. If any provision of this ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such provision shall not affect "any of the other provisions of this ordinance
SECTION 3. All ordinances, resolutions, potions or orders inconsistent with this ordinance are hereby superseded to the extent of such conflict.
SECTION 4. This ordinance shall take effect immediately upon its passage and approval.
