At the request of the Commissioner of Housing and Economic Development, I transmit herewith an ordinance authorizing an amendment to the eligibility for the Emergency Housing Assistance Program.

ORDINANCE
 
 
WHEREAS, the City of Chicago (the "City") is a home rule unit of government under Section 6(a), Article VII of the 1970 Constitution of the State of Illinois; and
 
WHEREAS, the City's Department of Housing and Economic Development ("HED") has as one of its primary purposes the revitalization, economic stability and welfare of the City's neighborhoods by improving the quality and availability of housing through various rehabilitation and housing redevelopment programs; and
 
WHEREAS, an Emergency Housing Assistance Program ("EHAP") has been authorized and is primarily funded by the City with certain proceeds of U.S. Department of Housing and Urban Development ("HUD") Community Development Block Grants; and
 
WHEREAS, EHAP provides forgivable loans on behalf of income-qualified owners of owner-occupied one- to four-unit buildings located within the City to provide emergency repairs for the correcting of dangerous, hazardous or life-threatening conditions of the buildings; and
 
WHEREAS, HED desires to increase the income eligibility of EHAP to make the program available to a larger group of building owners, and HED also desires to increase the flexibility of the City's funding of the program; now, therefore,
 
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
 
SECTION 1. The above recitals are expressly incorporated in and made a part of this ordinance as though fully set forth herein.
 
SECTION 2. The maximum annual income of building owners who may qualify to participate in EHAP shall be 80% of area median income as determined from time to time by HUD.
 
SECTION 3. HED is authorized to fund the emergency repairs under EHAP through either recoverable grants or forgivable loans to qualified owner-occupants.
 
SECTION 4. To the extent that any ordinance, resolution, rule, order or provision of the Municipal Code of Chicago, or part thereof, is in conflict with the provisions of this ordinance, the provisions of this ordinance shall control. If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this ordinance.
 
SECTION 5. This ordinance shall be effective as of the date of its passage and approval.
