To the President and Members of the City Council:
 
 
Your Committee on the Budget and Government Operations, having had under consideration an Ordinance authorizing a supplemental appropriation and an amendment to the year 2013 Annual Appropriation Ordinance necessary to reflect an increase in the amount of funds received from Federal, State, public, and/or private agencies and the execution of applicable agreements, and having been presented with a proposed Substitute Ordinance by the Office of Budget and Management; and having had the same under advisement, begs leave to report and recommend that Your Honorable Body pass the Substitute Ordinance transmitted herewith.
 
This recommendation was concurred in by a viva voce vote of the members of the Committee.

SUBSTITUTE ORDINANCE
 
 
; WHEREAS, the Annual Appropriation Ordinance for the year 2013 of the City of Chicago (the "City") contains estimates of revenues receivable as grants from agencies of the state and federal governments and public and private agencies; and
WHEREAS, in accordance with Section 8 of the Annual Appropriation Ordinance, the heads of various departments and agencies of the City have applied to agencies of the state and federal governments and public and private agencies for grants to the City for various purposes; and
 
WHEREAS, the City, through its Department of Cultural Affairs and Special Events ("DCASE") has been awarded private grant funds in the amount of $25,000 from The Richard H. Driehaus Foundation which shall be used for upgrading the Chicago Cultural Center Dance Studio; and
 
WHEREAS, the City, through DCASE has been awarded private grant funds in the amount of $5,000 from the Chicago Cultural Foundation which shall be used for the Gertrude Bernstein Memorial Garden at the Chicago Cultural Center; and
 
WHEREAS, the City through DCASE has been awarded private grant funds in the amount of $25,000 from the Terra Foundation for American Art which shall be used for the Rising Up: Hale Woodruff's Murals of Talladega College; and
 
WHEREAS, the City through its Department of Finance has been awarded private grant funds in the amount of $500,000 from the American Beverage Association which shall be used for the Chicago Lives Healthy program; and
 
WHEREAS, the City through its Department of Family and Support Services ("DFSS") has been awarded additional federal grant funds in the amount of $259,000 by the Chicago Housing Authority ("CHA") which shall be used CHA Family Support Services project; and
 
WHEREAS, the City through its Department of Police anticipates receiving ARRA Funds in the amount of $142,000 from the Illinois Criminal Justice Information Authority which shall be used for the ARRA-Ballistics Lab Equipment program; and
 
WHEREAS, the City through its Commission on Animal Care and Control has been awarded private grant funds in the amount of $18,000 by The American Society for the Prevention of Cruelty to Animals which shall be used for the Carroll Petrie Foundation Dog Rescue project; and
 
WHEREAS the City through its Department of Streets and Sanitation ("S & S") has been awarded federal grant funds in the amount of $73,000 from the United States Department of Agriculture, Forest Service which shall be used for the Emerald Ash Borer Urban Forest Restoration program; and

WHEREAS, the City through S&S has been awarded private grant funds in the amount of $20,000 by the Alliance for Community Trees and Siemens which shall be used for the Sustainable Community Tree Planting program; now, therefore,
 
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
 
SECTION 1. The sum of $1,067,000 not previously appropriated; representing increased grant awards is hereby appropriated from Fund 925 - Grant Funds for the-year 2013. The Annual Appropriation Ordinance is hereby amended by striking the words and figures and adding the words and figures indicated in the attached Exhibit A which is hereby made a part hereof.
 
SECTION 2. The Commissioner of DFSS is hereby authorized to execute an intergovernmental agreement, subject to the approval of the Corporation Counsel, with the CHA to implement the CHA Family Support Services project.
 
SECTION 3. To the extent that any ordinance, resolution, rule; order or provision of the Municipal Code of Chicago, or part thereof, is in conflict with the provisions of this ordinance, the provisions of this ordinance shall control. If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this ordinance.
