Ladies and Gentlemen:

At the request of the Commissioner of Aviation, I transmit herewith ordinances authorizing the execution of Use Agreements and Facility Leases at O'Hare International Airport.

Your favorable consideration of these ordinances will be appreciated.

ORDINANCE

WHEREAS, the City of Chicago ("City") is a home rule unit of government as defined in Section 6(a) of Article VII of the 1970 Constitution of the State of Illinois and, as such, may exercise any power and perform any. function pertaining to its government and affairs; and

WHEREAS, the City owns and operates, through its Department of Aviation, an airport known as Chicago O'Hare International Airport ("Airport") and has the authority to lease premises and facilities thereon and to grant other rights and privileges; and
WHEREAS, the Airport includes an International Terminal 5, and those airlines operating in International Terminal 5 enter into International Terminal Use Agreements and Facilities Leases ("ITU") in the form approved by the City Council on February 28, 1990 (the Journal of the Proceedings of the City Council of the City of Chicago, pages 12076-12211); and

WHEREAS, Delta Air Lines, Inc. ("Delta"), Expressjet Airlines, Inc. ("ExpressJet") and SkyWest Airlines, Inc. ("SkyWest") desire to operate in International Terminal 5, and the City desires to enter into a long term ITU with such Airlines and

WHEREAS, the Chicago Department of Aviation desires to enter into ITUs in the future with airlines at O'Hare to allow them to commence service upon receipt of all necessary Federal approvals; now, therefore,
