ORDINANCE
WHEREAS, The purpose of this ordinance is to correct two instances in Section 9-100-050(f) of the Municipal Code in which the word "city" erroneously appears instead of the correct word, which should be "cited"; and
WHEREAS, On March 21, 1990, the City Council of the City of Chicago passed an ordinance which created Code section 27.1-5(f), which was later renumbered as Code section 9-100-050(f) (see page 13565 of the Journal of Proceedings for that date). The fifth line of subsection (f) contained the phrase: "the registered owner of the cited vehicle . . ." (emphasis added); and
WHEREAS, The City Council next amended subsection (f) on March 26, 1996, which amendment appears at page 19182 of the Journal of Proceedings for that date. That Journal, however, in setting out the text of subsection (f), incorrectly used the word "city" instead of "cited" in the sixth line of subsection (f), even though that portion of subsection (f) was not being amended; and
WHEREAS, This erroneous appearance of "city" instead of "cited" was compounded in an ordinance that the City Council passed on December 7, 2005, which appears at pages 64881 through 64882 of the Journal of Proceedings for that date. That ordinance, following the mistaken template established on March 26, 1996, added a new sentence to the end of subsection (f) which included the phrase " the registered owner of the city vehicle . . ." (emphasis added) in line 6 from the top of page 64882; and
WHEREAS, It is necessary and appropriate to correct these errors; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. Page 19182 of the Journal of Proceedings of March 26, 1996 is hereby corrected by replacing the word "city," which appears in the sixth line of section 9-100-050(f) on that page, with the word "cited."
SECTION 2. The last sentence of subsection 9-100-050(f) of the Municipal Code is hereby amended by striking the word "city" and replacing it with the word "cited' as follows:
In the event a mailing sent pursuant to this section is returned as undeliverable, subsequent mailings may be sent to the address of the registered owner of the eity cited vehicle as recorded with the United States Postal Service.
