SUBSTITUTE ORDINANCE
WHEREAS, the Annual Appropriation Ordinance for the year 2013 of the City of Chicago (the "City") contains estimates of revenues receivable as grants from agencies of the state and federal governments and public and private agencies; and
WHEREAS, in accordance with Section 8 of the Annual Appropriation Ordinance, the heads of various departments and agencies of the City have applied to agencies of the state and federal governments and public and private agencies for grants to the City for various purposes; and
WHEREAS, the City through its Department of Cultural Affairs and Special Events has been awarded additional public grant funds in the amount of $230,000 from the Chicago Park District which shall be used for the Summerdance and World Music Festival Programs; and
WHEREAS, the City through its Department of Public Health has federal carryover grant funds in the amount of $1,070,000 from the United States Department of Health and Human Services, Substance Abuse and Mental Health Services Administration which shall be used for the Minority AIDs Initiative Targeted Capacity Enhancement Program; and
WHEREAS, the City through its Department of Family and Support Services has been awarded private grant funds in the amount of $1,000,000 by World Business Chicago which shall be used for the NATO Legacy Fund project; and
WHEREAS, the City through its Office of Emergency Management and Communications has been awarded public grant funds in the amount of $75,000 from the Chicago Transit Authority which shall be used for the Camera Safety Partnership Program; and
WHEREAS, the City, through its Department of Transportation ("CDOT") has been awarded additional federal grant funds in the amount of $5,516,000 from the Federal Highway Administration ("FHWA") which shall be used for the construction phase ofthe Surface Transportation Program; and
WHEREAS, the City, through CDOT has been awarded additional federal grant funds in the amount of $56,804,000 from FHWA which shall be used'for the Congestion Mitigation Air Quality Program; and
WHEREAS, the City through CDOT has been awarded additional federal grant funds in the amount of $2,800,000 from FHWA which shall be used for the High Priority/SAFTEA-LU Engineering Program; and
WHEREAS, the City through CDOT has been awarded additional public grant funds in the amount of $2,265,000 from the County of Cook which shall be used for the Cook County Highway Program; and

WHEREAS, the City through CDOT has been awarded additional federal grant funds in the amount of $13,092,000 from FHWA which shall be used for the engineering phase of the Surface Transportation Program; and
WHEREAS, the City through CDOT has been awarded state grant funds in the amount of $9,900,000 from the Illinois Department of Transportation ("IDOT") which shall be used for the Illinois Jobs Now Program; and
WHEREAS, the City through CDOT has been awarded federal grant funds in the amount of $397,000 from the Illinois Department of Natural Resources which shall be used for the Green Corps Invasive Species Removal Jobs in the Millennium Reserve Program; and
WHEREAS, the City through CDOT has been awarded federal grant funds in the amount of $110,000 from IDOT which shall be used for the State Planning and Research Fund Program; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. The sum of $93,259,000 not previously appropriated, representing increased grant awards is hereby appropriated from Fund 925 - Grant Funds for the year 2013. The Annual Appropriation Ordinance is hereby amended by striking the words and figures and adding the words and figures indicated in the attached Exhibit A which is hereby made a part hereof.
SECTION 2. The Commissioner of CDOT is hereby authorized to execute with the President of the County of Cook an intergovernmental agreement with the approval of the Corporation Counsel in connection with the Cook County Highway Program.
SECTION 3 To the extent that any ordinance, resolution, rule, order or provision of the Municipal Code of Chicago, or part thereof, is in conflict with the provisions of this ordinance, the provisions of this ordinance shall control. If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this ordinance.
SECTION 4. This ordinance shall be in full force and effect upon its passage and approval.

Your Committee on the Budget and Government Operations, having had under consideration an Ordinance authorizing a supplemental appropriation and an amendment to the year 2013 Annual Appropriation Ordinance necessary to reflect an increase in the amount of funds received from Federal, State, public, and/or private agencies and the execution of applicable agreements, and having been presented with a proposed Substitute Ordinance by the Office of Budget and Management; and having had the same under advisement, begs leave to report and recommend that Your Honorable Body pass the Substitute Ordinance transmitted herewith.
