Your Committee on Transportation and Public Way begs leave to report and recommend that Your Honorable Body pass A proposed vacation and dedication of portions of public alley in the block bounded by West Adams Street,  South Wood Street,  West Jackson Street and vacated South Honore Street in the 27th Ward.    This ordinance was referred to the Committee on February 3, 2014.
 
This recommendation was concurred unanimously by a viva voce vote of the members of the Committee with no dissenting vote.

INTERGOVERNMENTAL ORDINANCE
 
 
 
WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) of the 1970 constitution of the State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
 
 
 
WHEREAS, the properties at 214-224 S. Wood Street and approximately 213-225 S. Honore Street (vacated), are owned by the City Colleges of Chicago as titleholder: Board of Trustees of Community College District No. 508, A Body Politic and Corporate, a Municipal Corporation; and
 
 
 
WHEREAS, the Board of Trustees of Community College District No. 508, A Body Politic and Corporate proposes to assemble properties including the portion of the public alley to be vacated; and
 
 
WHEREAS, The City Council of the City, of Chicago, after due investigation and consideration, has determined that the nature and extent of public use and the public interest to be subserved is such as to warrant the vacation of part of the existing public alley, and the dedication of part of. a new alley as described in the following ordinance; now, therefore,
 
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO: SECTION 1. LEGAL DESCRIPTIONS
 
THE VACATION:
THAT PART OF A NORTH-SOUTH 16 FOOT PUBLIC ALLEY IN ASHLAND'S SECOND ADDITION TO CHICAGO, A SUBDIVISION OF THE WEST HALF OF THE NORTHEAST QUARTER OF SECTION 18, TOWNSHIP 39 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN (ANTE-FIRE) LYING WEST OF AND ADJOINING LOTS 29 THROUGH 31, INCLUSIVE, IN BLOCK 9 OF SAID ASHLAND'S SECOND ADDITION TO CHICAGO, LYING EAST OF AND ADJOINING PART OF LOT 2, LOTS 3 AND 4 AND PART OF LOT 5, INCLUSIVE, IN ASSESSOR'S DIVISION OF LOTS 12 TO 16, INCLUSIVE, OF BLOCK 9 OF SAID ASHLAND'S SECOND ADDITION TO CHICAGO, LYING SOUTH OF THE WESTERLY EXTENSION OF THE NORTH LINE OF SAID LOT 31 IN BLOCK 9 AND LYING NORTH OF THE WESTERLY EXTENSION OF THE SOUTH LINE OF SAID LOT 29, ALL IN COOK COUNTY, ILLINOIS.

THE DEDICATION:
THE WEST.27 FEET OF LOT 28 IN BLOCK 9 OF ASHLAND'S SECOND ADDITION TO CHICAGO, A SUBDIVISION OF THE WEST HALF OF THE NORTHEAST QUARTER OF SECTION 18, TOWNSHIP 39 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN (ANTE-FIRE) IN COOK COUNTY, ILLINOIS.
SAID PARCEL OF LAND HEREIN DESCRIBED CONTAINS 675 SQUARE FEET OR 0.015 ACRES, MORE OR LESS.
as shaded and legally described by the words "TO BE VACATED" and "HEREBY DEDICATED FOR PUBLIC ALLEY" on the plats hereto attached as Exhibit A and Exhibit B, which plats for greater clarity are hereby made a part of this ordinance, be and the vacation area is hereby closed, inasmuch as the same is no longer required for public use and'the public interest will be subserved by such vacation. '
 
 
SECTION 2. The vacation and dedication herein provided for are made upon the express condition that within 180 days after the passage of this ordinance, the Board of Trustees of Community College District No. 508, A Body Politic and Corporate, shall deposit.in the City Treasury of the City of Chicago, a sum sufficient to defray the costs of constructing the new alley portion for that portion of the alley hereby dedicated; arid removing paving and curb returns, sidewalk and curb at the entrance to that part of the public alley hereby vacated, similar to adjacent public sidewalk and curb, and in accordance with current Departmental standards for alley construction.
 
 
SECTION 3. The vacation herein provided for is made upon the express condition that within one hundred' eighty (180) days after the passage of this ordinance, the applicant shall file or cause to be filed for record in the Office of the Recorder of Deeds of Cook County, Illinois a certified copy of this ordinance, together with the attached plats, as approved by the Superintendent of Maps and Plats, and the executed Duty.to Build Agreement.
 
 
SECTION 4. This ordinance shall take effect and-be in force from and after its passage and publication. The vacation and dedication shall take effect and be in force from and after the recording of the Plats of Vacation and Dedication and the Duty to Build Agreement.
