ORDINANCE
 
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
 
SECTION 1. Section 10-28-797 of the Municipal Code of Chicago is hereby amended by inserting the language underscored and deleting the language struck through, as follows:
10-28-797 Severability Grease Containers-Identification.
The provisions of this article are severable. If any section, clause, provision, portion or application of thoso sections is determined by any court to be invalid for any reason, the validity ofthe remaining sections, clauses, provisions or portions of those sections, and their application to other circumstances, shall not be affected thereby. It is the intention ofthe city council that this article would have been enacted by the city council regardless of the invalid sections, clauses, provisions, portions or applications of those sections.
  1. Every person, or the person's agent, who erects, locates, constructs or maintains any grease container on the public way, or on any other unenclosed property owned or controlled by the City, shall label the grease container with the following information: the address of the person using the grease container: in the case of a business, the name of the business or businesses served by the grease container; the name and telephone number of the person providing service for that container; and, in the case of a residential building, the name ofthe person responsible for payment for service for that grease container at the building. The labeling shall be indelible, in letters no less than one inch high, in a color that contrasts clearly with its background, placed in a conspicuous location on the container.
  2. No person shall cover, alter, obscure or remove the identifying label reguired under subsection (a).
    1. Any person who violates this section shall be fined not less than $200.00 and not more than $500.00 for each offense. Each day that a violation continues shall constitute a separate and distinct offense.
 
SECTION 2. This ordinance shall take effect 10 days after its passage and publication.
