Reporting for your Committee on Economic, Capital and Technology Development for which a meeting was held on June 24, 2014; having had under consideration Six Class 6(b) tax incentive resolutions, ail were introduced at the May 28, 2014 City Council for the following properties: 4550 S. Packers Avenue, introduced by Alderman Willie Cochran; 4040 W. 40th Street, introduced by Alderman Michael Zalewski; 6850 W. 62nd Street, also introduced by Alderman Michael Zalewski; 2801 S. Western Avenue, introduced by Alderman Daniel Solis; Building 895 also known as 11535 West Touhy, and for Building 836, O'Hare International Airport, both introduced by Alderman Mary O'Connor, begs leave to report and recommend that Your Honorable Body Pass the proposed resolutions transmitted herewith.
 
These recommendations were concurred in by a viva voce vote of the members of the Committee.
 
RESOLUTION CLASS 6(B) REAL ESTATE TAX INCENTIVE FOR THE BENEFIT OF AERO O'HARE, LLC, AN ILLINOIS LIMITED LIABILITY COMPANY, AND
REAL ESTATE LOCATED GENERALLY AT 11535 WEST TOUHY AVENUE, ALSO KNOWN AS BUILDING 895 AT CHICAGO O'HARE INTERNATIONAL AIRPORT,
IN CHICAGO, ILLINOIS, PURSUANT TO COOK COUNTY, ILLINOIS REAL PROPERTY ASSESSMENT CLASSIFICATION ORDINANCE
 
WHEREAS, the Cook County Board of Commissioners has enacted the Cook County Real Property Assessment Classification Ordinance, as amended from time to time (the "Ordinance"), which provides for, among other things, real estate tax incentives to property owners who build, rehabilitate, enhance and occupy property which is located within Cook County and which is used primarily for industrial purposes; and
 
WHEREAS, the City of Chicago (the "City"), consistent with the Ordinance, wishes to induce industry to locate and expand in the City by supporting financial incentives in the form of property tax relief; and
 
WHEREAS, Aero O'Hare, LLC, an Illinois limited liability company (the "Applicant"), leases certain real estate owned by the City located generally at 11535 West Touhy Avenue, Chicago, Illinois 60666, also known as Building 895 at Chicago O'Hare International Airport, all as further described on Exhibit A hereto (the "Subject Property"); and
 
WHEREAS, the Applicant is constructing a new approximately 500,000 square foot industrial facility located on the Subject Property to be initially leased to Air Express International USA, Inc., an Ohio corporation d/b/a DHL Global Forwarding (the "Facility"); and
 
WHEREAS, the Applicant has filed with the Office of the Assessor of Cook County (the "Assessor") an eligibility application for a Class 6(b) tax incentive under the Ordinance; and
 
WHEREAS, it is the responsibility of the Assessor to determine that an application for a Class 6(b) classification or renewal of a Class 6(b) classification is eligible pursuant to the Ordinance; and
 
WHEREAS, the Ordinance requires that, in connection with the filing of a Class 6(b) eligibility application with the Assessor, the applicant must obtain from the municipality in which such real estate that is proposed for Class 6(b) designation is located a resolution expressly stating that the municipality has determined that the incentive provided by Class 6(b) is necessary for development to occur on such real estate and that the municipality supports and consents to the Class 6(b) classification by the Assessor; and
 
WHEREAS, the intended use of the Subject Property will provide significant present and future employment; and

SECTION VII - ACKNOWLEDGMENTS, CONTRACT INCORPORATION, COMPLIANCE, PENALTIES, DISCLOSURE
 
The Disclosing Party understands and agrees that:
  1. The certifications, disclosures, and acknowledgments contained in this EDS will become part of any contract or other agreement between the Applicant and the City in connection with the Matter, whether procurement, City assistance, or other City action, and are material inducements to the City's execution of any contract or taking other action with respect to tbe Matter. The Disclosing Party understands that it must comply with aD statutes, ordinances, and regulations on which this EDS is based.
  2. The City's Governmental Ethics and Campaign Financing Ordinances, Chapters 2-156 and 2-164 of the Municipal Code, impose certain duties and obligations on persons or entities seeking City contracts, work, business, or transactions. The full text of these ordinances and a training program is available on line at www.citvofchicago.org/Ethics. and may also be obtained from the City's Board of Ethics, 740 N.

  1. If the City determines that any information provided in this EDS is false, incomplete or inaccurate, any contract or other agreement in connection with which it is submitted may be rescinded or be void or voidable, and the City may pursue any remedies under the contract or agreement (if not rescinded or void), at law, or in equity, including terminating the Disclosing Party's participation in the Matter and/or declining to allow the Disclosing Party to participate in other transactions with the City. Remedies at law for a false statement of material fact may include incarceration and an award to the City of treble damages.
  2. It is the City's policy to make this document available to the public on its Internet site and/or upon request. Some or all ofthe information provided on this EDS and any attachments to this EDS may be made available to the public on the Internet, in response to a Freedom of Information Act request, or otherwise. The certifications, disclosures, and acknowledgments contained in this EDS will become part of any contract or other agreement between the Applicant and the City in connection with the Matter, whether procurement, City assistance, or other City action, and are material inducements to the City's execution of any contract or taking other action with respect to the Matter. The Disclosing Party understands that it must comply with all statutes, ordinances, and regulations on which this EDS is based.
  2. The City's Governmental Ethics and Campaign Financing Ordinances, Chapters 2-156 and 2-164 of the Municipal Code, impose certain duties and obligations on persons or entities seeking Chy contracts, work, business, or transactions. SECTION VII - ACKNOWLEDGMENTS, CONTRACT INCORPORATION, COMPLIANCE, PENALTIES, DISCLOSURE
The Disclosing Patty understands and agrees that;

The certifications, disclosures, and acknowledgments contained in tins EDS will become part of any contract or other agreement between the Applicant and tho Chy in connection with the Matter, whether procurement, City assistance, or other City action, and are material inducements to the City's execution of any contract or taking other action with respect to the Matter. The Disclosing Party understands that it must comply with all statutes, ordinances, and regulations on which this EDS is based.
  2. The City's Governmental Bthica and Campaign Financing Ordinances, Chapters 2-156 and 2-164 of the Municipal Code, impose certain duties and obligations on persons or entities seeking City contracts, work, business, or transactions.
