ORDINANCE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1: On behalf of the City of Chicago as landlord, the Commissioner of the Department of Fleet and Facility Management is authorized to execute a lease with NeighborSpace, as tenant, governing NeighborSpace's use of City-owned property located at 2902-54 West Lawrence Avenue; such lease to be approved by the Commissioner of the Department of Planning and Development and approved as to form and legality by the Corporation Counsel in substantially the following form:
LEASE

THIS LEASE is made and entered into this day of , 2014 by and
between, the CITY OF CHICAGO, an Illinois municipal corporation and home rule unit of government (hereinafter referred to as "Landlord" or "City"), and NEIGHBORSPACE, an Illinois not-for-profit corporation (hereinafter referred to as "Tenant"). Landlord and Tenant are sometimes jointly referred to as the "Parties."

RECITALS

WHEREAS, Landlord is the owner of the real property more commonly known as 2902-54 West Lawrence Avenue, Chicago, Cook County, Illinois; and

WHEREAS, the property located at 2902-54 West Lawrence Avenue has no present municipal use; and

WHEREAS, Landlord has agreed to lease to Tenant, and Tenant has agreed to lease from Landlord approximately 71,800 square feet of vacant land located at 2902-54 West Lawrence Avenue as depicted on Exhibit A attached hereto to be used as a community garden; and

NOW THEREFORE, in consideration of the covenants, terms and conditions set forth herein, the Parties hereto agree and covenant as follows:
