COMMERCIAL ORDINANCE
WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) ofthe 1970 constitution ofthe State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the properties at 5636-5648 S. Normal Avenue, 5616-5626 S. Normal Avenue, 425-447 W. 57th Street, 432-454 W. 57th Place, approximately 421-455 W. 58th Place (vacated), 420-454 W. 59th Street, 501-547 W. Garfield Boulevard, 500-550 W. 56th Street, 501 -551 W. 56th Street, 500-546 W. Tremont Street, approximately 5617-5627 S. Wallace Street, 501-547 W. Tremont Street, 5637-5649 S. Wallace Street, 500-544 W. 56th Place, 501-549 W. 56lh Place, 5653-5663 S. Wallace Street, and 5652-5662 S. Normal Avenue are owned by Norfolk Southern Railway Company, a Virginia Corporation ("Norfolk Southern Railway Company"); and
WHEREAS, Norfolk Southern Railway Company proposes to use the portion of the streets and alleys to be vacated herein for expansion ofthe company's intermodal transfer rail yard; and
WHEREAS, the City Council of the City of Chicago, after due investigation and consideration, has determined that the nature and extent ofthe public use and the public interest to be subserved is such as to warrant the vacation of part of public streets and alleys, described in the following ordinance; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1.
PARCEL 1;
ALL THAT PART OF THE EAST-WEST 16 FOOT WIDE PUBLIC ALLEY IN BLOCK 1 IN MILLER AND RIGDON'S SUBDIVISION OF THE OUT LOT OR BLOCK 29 OF SCHOOL TRUSTEE'S SUBDIVISION OF SECTION 16, TOWNSHIP 38 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPLE MERIDIAN, EXCEPT THE NORTH 134 FEET THEREOF, RECORDED MAY 29, 1873, BOOK 5 PAGE 92, AS DOCUMENT NUMBER 123098; LYING WEST OF AND ADJOINING THE WEST LINE OF S.
