COMMERCIAL ORDINANCE
WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) of the 1970 constitution of the State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and
WHEREAS, the properties at 2348-2356 W. 107th Street, 10631-10643 S. Western Avenue and 10647-10659 S. Western Avenue are owned by Beverly Western Partners LLC, an Illinois Limited Liability ("Beverly Western Partners, LLC"); and
WHEREAS, Beverly Western Partners, LLC proposes to use the portion ofthe alley to be vacated herein to assemble properties for a commercial redevelopment including a Buona Restaurant; and
WHEREAS, the City Council of the City of Chicago, after due investigation and consideration, has determined that the nature and extent of the public use and the public interest to be subserved is such as to warrant the vacation of part of public alley, described in the following ordinance; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. THAT PART OF THE EAST-WEST 16 FOOT PUBLIC ALLEY LYING NORTH OF LOTS 13 AND 14 AND SOUTH OF LOT 15 IN BLOCK 4 IN JERNBERG'S SUBDIVISION OF THE WEST HALF OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER OF THE WEST HALF OF THE NORTHEAST QUARTER OF THE SOUTHWEST QUARTER OF THE NORTHWEST QUARTER OF SECTION 18, TOWNSHIP 37 NORTH, RANGE 14 EAST OF THE THIRD PRINCIPAL MERIDIAN RECORDED JUNE 25,1890 AS DOCUMENT 1293095 AND DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE NORTH LINE OF SAID LOT 14 LYING 50.00 FEET EAST OF AN PARALLEL TO THE WEST LINE OF SAID SECTION 18; THENCE, ON AN ASSUMED BEARING, NORTH 0 DEGREES 00 MINUTES 00 SECONDS EAST, ALONG SAID PARALLEL LINE, 16.00 FEET TO A POINT ON THE SOUTH LINE OF SAID LOT 15; THENCE SOUTH 89 DEGREES 56 MINUTES 21 SECONDS EAST, ALONG THE SOUTH LINE OF SAID LOT 15,99.36 FEET TO A POINT ON THE NORTHERLY EXTENSION OF THE EAST LINE OF SAID LOT 13; ...
