ORDINANCE

WHEREAS, The City of Chicago is a home rule unit of government pursuant to the 1970 Illinois Constitution, Article VII, Section 6 (a): and

WHEREAS, Pursuant to'its home rule power, the City of Chicago may exercise any power and perform any function relating to its government and affairs including promoting the quality of life, safety, and the welfare of its citizens; and

W'HEREAS, Recent events in Chicago and in other cities tliroughout tlie United States regarding law enforcement professionals highlight the reality that the use of force is a defining issue in modern policing; and

WHEREAS, The Chicago Police Department's directives regarding the use of force is premised on the Fourth Amendment ofthe U.S. Constitution which specifies that a police officer's use of force must be reasonable; and

WHEREAS, The Chicago Police Department requires ongoing training and instruction to continuously improve the administration of law enforcement efforts within the City of Chicago; and

WHEREAS. Annual training regarding the use of force must be utilized as a tool to continuously improve the policing efforts of all sworn members of tlie Department and to ensure they are trained to accept the tremendous power and trust afforded them by the community; and

WHEREAS, According to the National Alliance of Mental Illness (NAMI), one in five adults in tlie U.S. experiences a mental illness in a given year, which may lead to problems when dealing with police; and

WHEREAS, Annual mental health awareness and crisis intervention training must be utilized by all sworn members of the Department as a tool to identify and understand mental illness and intellectual disabilities which may be observed or encountered during an officer's patrol; and

WHEREAS, In addition to the Annual Prescribed Weapon Qualification and Taser Recertification program which requires all sworn members of the Department to qualify with their duty weapon, quarterly instruction must be available to improve tactical weapon handling skills and marksmanship; and

WHEREAS, It is imperative to underscore the authority and increase the credibility of the Chicago Police Department and lo insure that all sworn members receive adequate and meaningful training which will enhance their skills as law enforcement professionals; and NOW, THEREFORE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. The above recitals are expressly' incorporated herein and made part hereof as though fully set forth herein.
SECTION 2. Chapter 2-84-050 ofthe Municipal Code ofthe Citv of Chicago is hereby amended by inserting the language underscored and deleting the language struck through as follows:
2-84-050 Superintendent of Police - Powers and duties.
Subject to the rules ofthe department and the instruction ofthe board, said superintendent shall have the power and duty:
To administer the affairs ofthe department as its chief administrative officer;
To organize the department with the approval of the board;
To make appointments, promotions, transfers of and to take disciplinary action against employees of the department other than the secretary of the board;
To appoint, discharge, suspend or transfer the employees of the department other than the secretary of the board and to issue instructions to said employees other than the secretary in the line of their duties. Subsections (3) and (4) are subject to the civil service provisions;
To expend the funds of the department in accordance with the provisions of the budget appropriations: "
To recommend to tlie board an annual departmental budget covering the anticipated revenues and expenditures of the department conforming as far as practicable to tlie forms and dates provided for in relation to the general city budget;
To certify all expenditures of the department lo the city comptroller: and
(8) To exercise sueh-furtker powers in the administration ofthe department as ma)' be
eenferrod upon him by the-boardr
( 8) The Superintendent of Police shall establish and monitor the following training programs, and certify annually that the professional training of each sworn member ofthe Department has occurred:
a) Use of Force Training: not less than four hours annually regarding the appropriate amount of force to be used to affect a lawful purpose:
Mental Health Awareness & Crisis Intervention Training: not less than one hour of menial health and crisis intervention training session in each quarter to identify mental illness and intellectual disabilities which may be observed or encountered during the course of a member's tour of duty:
Firearms Training: quarterly firearms training, requiring the discharge of not less than fifty ("50) rounds of ammunition.
("91 To exercise such further powers in the administration of the department as may be conferred upon him by the board.



SECTION 3. If any section, subsection, paragraph, or part of this ordinance is for any reason held to be unconstitutional or invalid by any final court of competent jurisdiction, such decision shall not affect the validity or effectiveness ofthe remaining portions of this ordinance.
