ORDINANCE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

SECTION 1. Sections 2-57-070, 2-57-160, and 2-84-050 of the Municipal Code of Chicago are hereby amended by deleting the language stricken through and inserting the language underscored, as follows:

2-57-070 Investigations not concluded to be concluded within six months two years.

All investigations authorized pursuant to this chapter shall be concluded within two years. If the chief administrator does not conclude an investigation within six months after its initiation, the chief administrator shall notify the mayor's office, the city council committee on public safety, the complainant, and the employee named in the complaint or his or her counsel of the general nature ofthe complaint or information giving rise to the investigation and the reasons for failure to complete the investigation within six months.

2-57-160 Public policy - statute of limitations.

The public policy of this chapter is to make certain that complaints concerning police misconduct and abuse are resolved fairly and timely. Investigations authorized pursuant to this chapter must be initiated within 5 years after the commission of the act upon which the investigation is based. All collective bargaining agreements must be in accord with this policy.

2-84-050 Superintendent of police - Powers and duties.

Subject to the rules of the department and the instruction of the board, said superintendent shall have the power and duty:
To administer the affairs of the department as its chief administrative officer;
To organize the department with the approval of the board;
To make appointments, promotions, transfers of and to take disciplinary action against employees of the department other than the secretary of the board;
To appoint, discharge, suspend or transfer the employees of the department other than the secretary of the board and to issue instructions to said employees other than the secretary in the line of their duties. Subsections (3) and (4) are subject to the civil service provisions. All charges for which removal or discharge, or suspension of more than 30 days is recommended must be brought within 5 years after the commission of the act upon which the charge is based;
To expend the funds of the department in accordance with the provisions of the budget appropriations;
To recommend to the board an annual departmental budget covering the anticipated revenues and expenditures of the department conforming as far as practicable to the forms and dates provided for in relation to the general city budget;
To certify all expenditures of the department to the city comptroller; and

(8) To exercise such further powers in the administration of the department as may be conferred upon him by the board.

SECTION 2. This ordinance shall be in full force upon passage and publication.
