INTERGOVERNMENTAL DEDICATION ORDINANCE

 

 

WHEREAS, the City of Chicago ("City") is a home rule unit of local government pursuant to Article VII, Section 6 (a) of the 1970 constitution of the State of Illinois and, as such, may exercise any power and perform any function pertaining to its government and affairs; and

 

 

WHEREAS, the properties at 4100-4158 W. 61st Street, are owned by the Public Building Commission of Chicago, a Municipal Corporation ("Developer"); and

 

 

WHEREAS, the Developer proposes to dedicate additional width in the public sidewalk as now built, to serve the adjacent Chicago Public School site known as the Southwest Area Middle School property, along the portion of the 61st street to be dedicated; and

 

 

WHEREAS, The City Council of the City of Chicago, after due investigation and consideration, has determined that the nature and extent of public use and the public interest to be subserved is such as to warrant acceptance of the dedication of part of the public right of way described in the following ordinance; now, therefore,

 

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

 

SECTION 1 THAT PART OF THE EAST HALF OF THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 15, TOWNSHIP 38 NORTH, RANGE 13 EAST OF THE THIRD PRINCIPAL MERIDIAN, AND THOSE PARTS OF LOTS 10 AND 11 IN FRED'K H. BARTLETT'S KEELER AVE. AND 61st ST. ADDITION, BEING A SUBDIVISION OF THE SOUTHWEST QUARTER OF THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF SAID SOUTHEAST QUARTER OF SECTION 15, ACCORDING TO THE PLAT THEREOF RECORDED MAY 3, 1923, AS DOCUMENT 7912322, TOGETHER WITH THAT PART OF THE 16 FOOT NORTH-SOUTH ALLEY THAT WAS VACATED MARCH 10, 1928, PER DOCUMENT 995149, LYING BETWEEN SAID LOTS 10 AND 11, TOGETHER WITH THAT PART OF THE 33 FOOT ROADWAY THAT WAS VACATED MARCH 10, 1928, PER DOCUMENT 995149, LYING EAST OF AND ADJACENT TO SAID LOT 10, ALL TAKEN AS A TRACT, DESCRIBED AS FOLLOWS: BEGINNING AT THE SOUTHWEST CORNER OF SAID LOT 11; THENCE NORTH 1 DEGREE 39 MINUTES 53 SECONDS WEST 7.50 FEET, ALONG THE WEST LINE OF SAID LOT 11, BEING ALSO THE EAST LINE OF S. KEELER AVENUE, TO THE NORTH LINE OF THE SOUTH 40.50 FEET OF THE SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF SAID SOUTHEAST QUARTER OF SECTION 15; THENCE NORTH 88 DEGREES 45 MINUTES 56 SECONDS EAST, ALONG SAID NORTH LINE, 600.39 FEET TO THE WEST LINE OF THE EAST 33.00 FEET OF SAID SOUTHWEST QUARTER OF THE NORTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 15, BEING ALSO THE WEST LINE OF S. KARLOV AVENUE; THENCE SOUTH 1 DEGREE 36 MINUTES 34 SECONDS EAST, ALONG SAID WEST LINE, 7.50 FEET TO THE NORTH LINE OF W. 61ST STREET; THENCE SOUTH 88 DEGREES 45 MINUTES 56 SECONDS WEST, ALONG SAID NORTH LINE, 600.39 FEET TO THE POINT OF BEGINNING; IN COOK COUNTY, ILLINOIS. TOTAL AREA HEREBY DEDICATED 4503 SQUARE FEET OR 0.103 ACRES MORE OR LESS as shaded and legally described by the words "HEREBY DEDICATED" on the plat hereto

attached as Exhibit A, which drawing for greater clarity, is hereby made a part of this ordinance, be and the same is hereby dedicated, inasmuch as the same is required for public use and the public interest will be subserved by such dedication.

 

 

SECTION 2. The Developer acknowledges that any private sewers, appurtenances and connections within the area to be dedicated shall be abandoned, relocated, and shall be maintained at the Developers expense, or established as public through a City Council ordinance. In the event that any sewer is abandoned, the abandonment plans must be reviewed, approved and permitted by the Department of Water Management, Sewer Design Section prior to work.

 

 

SECTION 3. The dedication herein provided for is made upon the express condition that within one hundred eighty (180) days after the passage of this ordinance, the Developer or its assign shall file or cause to be filed for recording with the Office of the Recorder of Deeds of Cook County, Illinois a certified copy of this ordinance, together with the associated full sized plat as approved by the Department of Transportation's Acting Superintendent of Maps and Plats.

 

 

SECTION 4. This ordinance shall take effect and be in force from and after its passage and publication. The dedication shall take effect and be in force from and after its recording.
