SUBSTITUTE ORDINANCE

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:

 

SECTION 1. Section 4-60-140 of the Municipal Code of Chicago is hereby amended by adding the language underscored, and by deleting the language struck through, as follows:

4-60-140 Prohibited activities.

(h)                     It shall be unlawful for any licensee or any officer, associate, member,
representative, agent or employee of a licensee to divide a manufacturer's package containing
more than one container of beer
7 or malt liquor or ale, if the capacity of an individual container is
16 ounces or less, in order to sell an individual container, except for consumption on the
licensed premises.

(i)                     It shall be unlawful for any licensee or any officer, associate, member,
representative, agent or employee of a licensee to sell, give, offer or expose for sale, or deliver
an individual container of beer
T or malt liquor or ale with a capacity of 16 ounces or less, except
for consumption on the licensed premises.

(I)      No holder of a package goods license shall sell, permit to be sold, or give away single containers of wine or liquor that hold less than 25 fluid ounces (739 milliliters), or single containers of beer or malt liquor that hold less than 41 fluid ounces (1213 milliliters) between 12:00 a.m. (midnight) and the legally established hour of closing. The restriction of this subsection does not apply to a manufacturer's package containing more than one container of beer, malt liguor, wine, or liguor that is sold as a single unit. A licensee open after midnight shall post a sign visible in the area of the sales register clearly communicating the prohibition on the sale after midnight of single containers described in this subsection.

SECTION 2. This ordinance shall be in full force and effect upon passage and publication.

Your Committee on License and Consumer Protection, having under consideration a substitute ordinance introduced by Aldermen Hopkins, Reilly, Moreno, Cappleman, Villegas, Smith, Scott, Reboyras and Silverstein (which was referred on October 5, 2016), to amend Section 4-60-140 of the Municipal Code of Chicago concerning package goods license holders inability to sell or allow consumption of alcoholic liquor on or adjacent to licensee's premises during business hours, begs leave to recommend that Your Honorable Body pass the ordinance which is transmitted herewith.

This recommendation was concurred in by a viva voce vote of the members of the committee on August 30, 2017.
