SUBSTITUTE RESOLUTION
WHEREAS, Illinois Public Act 99-0727 (the "Act") was signed by Governor Rauner on August 5, 2016 and became effective on January 1, 2017; and
WHEREAS, The Act, which contains provisions similar to the Federal Fixing America's Surface Transportation ("FAST") Act, Pub. L. 114-94, authorizes units of local government to consult roadway design publications outside of the Illinois Department of Transportation's Bureau of Local Roads Manual for the construction of highways, so long as the publication has been approved by the Federal Highway Administration (FHWA), the local government adopts the design publication, and the design otherwise complies with applicable federal laws; and
WHEREAS, There are roadway design publications approved by the FHWA that, if used by the City of Chicago Department of Transportation ("CDOT"), would allow for greater design flexibility, including the opportunity to produce lower cost hot mix asphalt pavements, while ensuring the safety and performance of pavements designed under such alternative publications; and
WHEREAS, The City Council is committed to the pursuit of available means and methods which can provide cost savings to taxpayers, more efficient productivity within a finite budget, and improved overall quality of work; now, therefore,
BE IT RESOLVED, That we, the Members of the City Council of the City of Chicago, assembled this nineteenth day of April, 2017, do hereby call upon CDOT to evaluate and consider adopting and implementing the methods, findings, and recommendations contained within the following roadway design publications approved by the FHWA in CDOT's hot mix asphalt road program:
Design Considerations When Using Reclaimed Asphalt Shingles (RAS) in Asphalt Mixtures AASHTO PP 78-16;
"Investigation of Low Temperature Cracking in Asphalt Pavement - Phase II Final Report 2012-23 ASTM D 7313";
AASHTO T 324 - Hamburg Wheel-Track Testing of Compacted Hot Mix Asphalt (HMA); following IDOT Standard Specifications 2016 - 1030.04 Mixture Design (Criteria); and
BE IT FURTHER RESOLVED, That we hereby call upon CDOT to evaluate and consider adopting and implementing the methods, findings, and recommendations of the following roadway design programs and publications approved by the FHWA in CDOT's hot mix asphalt road program:
1. "Rejuvenator for Enhancing RAP Applications and Improving Material Compatibility" Fundamental Properties of Asphalts and Modified Asphalts III Product: FP 16 FHWA White Paper (March 2015);
2. "The Use of Recycled Tire Rubber to Modify Asphalt Binder & Mixtures" FHWA TechBrief FHWA-HIF-14-015 (September 2014);
3. "Use of Contractor Test Results in the Acceptance Decision, Recommended Quality Measures, and the Identification of Contractor/Department Risks" FHWA Technical Advisory T 6120.3 d; and
BE IT FURTHER RESOLVED, That we hereby call upon CDOT to maximize the use of post-consumer recyclable materials in its hot mix asphalt road program; and

BE IT FURTHER RESOLVED, That we hereby call upon the commissioner of CDOT, or a knowledgeable designee, to appear before the City Council Committee on Transportation and the Public Way at its June meeting to report on the progress of CDOT's evaluation and implementation of the foregoing items.
