Amendment of ordinance approving designation of Enterprise Zone 6
|
ORDINANCE
WHEREAS, pursuant to an ordinance adopted by the City Council (the "City Council") of the City of Chicago (the "City") on December 14, 2016 and published in the Journal of Proceedings ofthe City Council ofthe City (the "Journal of Proceedings") at pages 39323 -39335 (the "Original Ordinance"), and under the provisions ofthe Illinois Enterprise Zone Act, 20 ILCS 655/1 et seq. ("Illinois Enterprise Zone Act"), the City designated an area ofthe City as proposed Enterprise Zone 6 ("Zone ") in order to apply for certification by the State of Illinois through its Department of Commerce and Economic Opportunity (the "State") that Zone 6 qualifies for State enterprise zone status; and
WHEREAS, the City followed all required procedures in the selection and designation of Zone 6 as a proposed enterprise zone as required under the Illinois Enterprise Zone Act and the Chicago Enterprise Zone Ordinance, Chapter 16-12 ofthe Municipal Code of Chicago (the "Chicago Enterprise Zone Ordinance"), including holding a public hearing on November 15, 2016 (the "Public Hearing"), pursuant to a notice published in the Chicago Sun-Times on November 7, 2016; and
WHEREAS, the Public Hearing notice included a legal description ofthe boundaries of the proposed Zone 6, which legal description is attached hereto as Schedule 1 (the "Legal Description"), and the boundaries of Zone 6 set forth in the Legal Description were discussed at the Public Hearing; and
WHEREAS, a subsequent review of Exhibit A to the Original Ordinance discovered that an incorrect legal description and boundary map were attached to the Original Ordinance; and
WHEREAS, it is desirable and in the best interests ofthe citizens ofthe City for the City to amend the Original Ordinance to correct the error; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. The above recitals are incorporated herein and made a part hereof and are adopted as findings ofthe City Council.
SECTION 2. The Original Ordinance is hereby amended and corrected by replacing Exhibit A to the Original Ordinance with Schedule 1 attached hereto, which reflects the intended boundary of Zone 6.
SECTION 3. If any provision of this ordinance shall be held invalid or unenforceable for any reason, the invalidity or unenforceability of such provision shall not affect any of the remaining provisions of this ordinance.
SECTION 4. All ordinances, resolutions, motions or orders in conflict with this ordinance are hereby repealed to the extent of such conflict.
SECTION 6. This ordinance shall be in full force and effect immediately upon its passage and approval.
