STREET RENAMING ORDINANCE FOR A PORTION OF N. ELSTON AVENUE AS "N. ELSTON COURT"

 

 

WHEREAS, pursuant to an ordinance adopted by the City Council of the City of Chicago ("City Council") on July 20, 2016 and published in the Journal of Proceedings of the City Council ("Journal") for such date at pages 29310 - 29324 ("Original Ordinance"), the City Council authorized the opening and rerouting of the previous intersection of N. Damen Avenue, N. Elston Avenue and W. Fullerton Avenue to improve safety and encourage development in the area; and

WHEREAS, pursuant to Section 2 of the Ordinance the Chicago Department of Transportation was required to record the Original Ordinance and associated plats ("Plats") with the Cook County Recorder of Deeds within 180 days from the date of the final approval by the City Council; and

WHEREAS, pursuant to an ordinance adopted by the City Council on January 25, 2017 and published in the Journal for such date at pages 42007 - 42022, additional time beyond the 180 days set forth in the Original Ordinance was granted for the recordation of the Original Ordinance and the Plats; and

WHEREAS, the intersections set forth in the Original Ordinance have now been reconfigured as described in the Original Ordinance and Plats; and

WHEREAS, the Original Ordinance and Plats were recorded with the Cook County Recorder of Deeds on August 16, 2017 as document nos. 1722819028 and 1722819029 respectively; and

WHEREAS, a portion of the originally configured N. Elston Avenue generally described as being between the south line of W. Fullerton Avenue and the west line of the newly configured N. Elston Avenue to the south, must be renamed as "N. Elston Court"; and

WHEREAS, a limited number of properties lying along the originally configured section of N. Elston Avenue lying between the south line of W. Fullerton Avenue and the west line of newly reconfigured N. Elston Avenue to the south, will now need a change of address with the correct "N. Elston Court" street name; and

WHEREAS, those properties formerly known as 2321 to 2384 N. Elston Avenue, as highlighted for clarity on page 1 of the aforementioned recorded Plat hereto attached as EXHIBIT A, will specifically be affected by the street name change to N. Elston Court; and

 

 

WHEREAS, the commissioner ("Commissioner") of the Chicago Department of Transportation is authorized to name streets and assign legal addresses within the limits of the City of Chicago in accordance Section 2-102-030(n) of the Municipal Code of the City of Chicago;

 

 

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO

 

 

SECTION 1.  The above recitals are expressly incorporated in and made a part of this ordinance as though fully set forth herein.

 

 

SECTION 2.  The name of the aforementioned section of former N. Elston Avenue is changed to N. Elston Court.

 

 

 

SECTION 3.  The number portion of the existing addresses will remain the same.

 

 

SECTION 4. The Commissioner of Transportation shall notify, in writing, the affected properties, City service providers, the County, and the United States Post Office serving the area affected by the name change, not more than 30 days subsequent to the passage of this ordinance.

 

 

SECTION 5. The Commissioner of Transportation is authorized and directed to do all such acts and things, including without limitation the placement of street name signs with the new street name, and to execute and deliver any and all agreements, documents, instruments or certificates, as she deems necessary, advisable or appropriate, to effectuate this ordinance. All of the acts which are in conformity with the intent and purposes of this ordinance, whether heretofore or hereafter taken or done shall be and the same are in all respects ratified, confirmed, authorized, and approved hereby in all respects.

 

 

SECTION 6.  This ordinance shall take effect upon its passage and approval.
