ORDINANCE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHICAGO:
SECTION 1. Section 2-16-010 of the Municipal Code of Chicago is hereby amended by adding the language underscored, and by deleting the language struck through, as follows:
2-16-010 Chicago Animal Care animal care and Control control - Establishment and composition.
There is hereby established an executive department of the municipal government of the City which shall be known as Chicago Animal Care and Control, which shall have the powers and duties set forth in this chapter. The Department shall be administered by an Executive Director, who shall be appointed by the Mayor, subject to approval by the City Council, and staffed by such other employees as may be provided for in the annual appropriation ordinance. Words and phrases used in this chapter shall have the meaning set forth in Section 7-12-020, unless the context indicates otherwise.


SECTION 2. Section 2-16-015 of the Municipal Code of Chicago is hereby amended by adding the language underscored, and by deleting the language struck through, as follows:
2-16-015 Executive director - Powers and duties.
The Executive Director shall have general supervision over the Department and its employees, and also the following powers and duties:

(gj) To create and promulgate such programs, policies,, and rules as are necessary or useful to implement the administration and enforcement ofthis Chapter and Chapter 7-12.

(k) To accept the transfer of animals, and to transfer animals in the custody of the Department to foster homes, humane societies, or permanent homes through adoption, and to enter into agreements governing such transfers. Any animal transferred to the Department pursuant to this subsection shall become a City-owned animal, as defined in Chapter 7-12.

(I) To enter into partnerships and execute contracts for services, subject to the availability of duly appropriated funds, that improve animal care and Quality of life within any animal control center.

References in the Municipal Code to the Executive Director shall be deemed to include the Executive Director's designee(s).


SECTION 3. Section 7-12-020 of the Municipal Code of Chicago is hereby amended by adding the language underscored, as follows:
7-12-020 Definitions.
As used in this chapter, the following are defined and shall be construed as hereinafter set out unless it shall be apparent from the context that a different meaning is intended:

"Cat" means any live male or female cat (Felis catus).

"City-owned animal" means an animal that has become the property of the Citv through: (i) the City's possession of the animal and the owner's failure to redeem the animal within the mandated time or (ii) the owner's voluntary transfer of possession of the animal to the Citv.
"Commission" means the Commission on Animal Care and Control.
(Omitted text is unaffected by this ordinance) "Executive Director" means the Executive Director of the Department.
"Foster home" means a private or public facility that the Director has deemed suitable for the temporary care of animals, that accepts the transfer of one or more animals from the Department and cares for that animal until the Director effects the return of the animal to the Department or places it for adoption.

"Guard dog" means any dog used primarily for the purpose of defending, patrolling, or protecting property or life at a commercial establishment other than a farm; provided that, "Guard dog" does not include stock dogs used primarily for handling and controlling livestock or farm animals; provided further, that "Guard dog" shall not include any dbg that is the property of any local, state or federal government.

SECTION 4. Section 7-12-070 of the Municipal Code of Chicago is hereby amended by adding the language underscored, and by deleting the language struck through, as follows:
7-12-070 Facilities to be used for impoundments.
For purposes of impoundment, the Executive Director shall utilize: (i) an animal control center, (ii) a foster home, (iii) or the facilities of any humane society properly equipped and willing to impound animals, or, {iv] if the animal shall be of a species that may be better or more safely impounded elsewhere, the Executive Director may designate an alternate facility that is properly equipped and willing to accept the animal.


SECTION 5. Section 7-12-110 of the Municipal Code of Chicago is hereby amended by adding the language underscored, and by deleting the language struck through, as follows:
7-12-110 Adoption Transfer of unredeemed City-owned animals.
The Department shall designate, and the Executive Director shall cause to have posted or published, the day or days of each week and the hours when unredeemed City-owned animals in possession of the Department shall be offered: (i) to the public for inspection adoption; (ii) for foster care; or (iii) for transfer to a humane society and adoption.
Any City-owned dog or cat, as necessary, shall be sterilized, vaccinated, and microchipped prior to transfer for adoption.

(c) The Executive Director a4so shall designate promulgate rules, with input from the Department, regarding qualifications for adoptive owners, foster homes, and humane societies

to receive animals transferred by the Department reasonable ownership standards deemed necessary for the care of adoptive animals, including inoculation and enforcement of neutering and spaying requirements for all dogs and cats adopted.


SECTION 6. The amendment to Section 2-16-015 pertaining to the City's power to receive and transfer ownership of animals is intended to clarify, rather than to change, existing law.


SECTION 7. This ordinance shall be in full force and effect following due passage and approval.
